  • Both amazon and the seller were aware that I no longer was in contact with the seller.

I was informed by both amazon and the seller that I would receive the gift certificate, otherwise I would have taken a credit note with the company????

So yes, a new contract was made with me and the second amazon spokesman admitted that I had been let down by amazon!!!

I am curious to know why you requested a gift certificate instead of a refund. Was it because you realised that a refund would certainly go to your ex? If so, then why would you expect them to return the gift certificate to you either merely because you asked them to? It is bad luck for you but realistically you must be aware that a company will always reimburse the person who made the purchase regardless of any request by you to do otherwise.

Unfortunately, your relationship issues are of no interest to Amazon whatsoever. You can't really expect them to alter their procedures to accommodate your personal problems.

I don't think a new contract was made with you. Their contract was with your ex, they can't just override that because you asked them to. Amazon have acted appropriately albeit not in your favour unfortunately.

I don't agree that is right though, I asked them repeatedly before I sent the item if this would be sent as a gift card to me?? I was told by both the seller and amazon this would be the case.

Otherwise I would have kept the goods?

You are not required to agree or to disagree; the contract was between the purchaser and the vendor.
Perhaps, when you contacted Amazon they were not clear as to who had purchased the goods.
Why would have kept a faulty garment? For spite?

It's not *that* much money; at least you haven't got an unwearable garment cluttering up your home.

Actually if look on the Amazon website it does say the following, though in the case of the OP paragraph 3 applies.
How can I return something I didn't order myself?

    Return a gift

If you return a gift purchased for you at Amazon.co.uk, you'll receive a gift certificate for the value of your return, which you can use as part or full payment for future purchases from our website. Don't worry, we won't let the person who sent you the gift know about your return.

Please remember that normal returns criteria apply unless the return is due to an error on our part. If the return isn't due to an error on our part, the refund won't include the cost of gift-wrapping or other services provided in connection with the purchase. The cost of returning the item to us won't be included, unless you're returning shoes that were delivered to an address within the UK.

If you received or purchased a gift that was fulfilled by a third-party seller, you'll need to contact the seller directly about the return. To return a Marketplace gift or item, please see Arranging Marketplace Returns and Refunds.

    .

Note: Gift recipients are not eligible for instant refunds. You will receive your electronic gift certificate 3-5 days after we receive the return of your item.

Make up your mind... would've kept the goods or taken a credit note?

    Your credability is waning. ;)

That would apply if the sender ticked gift, which the sender didn't do.

The situation here is the only mistake made by Amazon was when they informed the OP they would get the gift card.

The actual process itself is correct given the Ex was the one with the contract.

No contract was formed between you and Amazon because you provided no consideration. In lay terms, something needs to pass both ways in order for a contract to be formed.

That only applies where the buyer has marked the item as a gift.

Exactly. The OP's issue is with the third party seller it would appear which means Amazon are not responsible for the OP's problem.

It is also is worth noting that there is nothing in that link in paragraph 3 about gifts.

I imagine all they are politely saying in paragraph 3 is that "Amazon cannot help when gifts are purchased from marketplace sellers".
