Both amazon and the seller were aware that I no longer was in contact with the seller.
I was informed by both amazon and the seller that I would receive the gift certificate, otherwise I would have taken a credit note with the company????
So yes, a new contract was made with me and the second amazon spokesman admitted that I had been let down by amazon!!!0 -

I am curious to know why you requested a gift certificate instead of a refund. Was it because you realised that a refund would certainly go to your ex? If so, then why would you expect them to return the gift certificate to you either merely because you asked them to? It is bad luck for you but realistically you must be aware that a company will always reimburse the person who made the purchase regardless of any request by you to do otherwise.
Unfortunately, your relationship issues are of no interest to Amazon whatsoever. You can't really expect them to alter their procedures to accommodate your personal problems.
I don't think a new contract was made with you. Their contract was with your ex, they can't just override that because you asked them to. Amazon have acted appropriately albeit not in your favour unfortunately.0 -

You are not required to agree or to disagree; the contract was between the purchaser and the vendor.
Perhaps, when you contacted Amazon they were not clear as to who had purchased the goods.
Why would have kept a faulty garment? For spite?

That would apply if the sender ticked gift, which the sender didn't do.
The situation here is the only mistake made by Amazon was when they informed the OP they would get the gift card.
