Cancelling 5 year warranty 2 years in?

I bought a car off finance, was told because of my age I couldn't get the car unless I agreed to the £2k warranty. Being very stupid, I took it. 2 Years later, gearbox fails, I'm basically told the warranty isn't worth the paper it's written on by the finance company, who advise me to ring Carcraft and they do have the option to remove the warranty. Ring carcraft, get told 'you signed, tough'. Is there any legal way out of paying this? Preferably I would like a refund of the whole policy, as it's a farce, but I'm aware there's no chance of that, but can I even get the payments taken off going forward? How these guys haven't been shut down for this I don't know.

Read the terms and conditions on the paperwork you got at the time.

They have not been shut down because people keep buying cars from them.

There are bad reviews all over the internet going back many years, yet you still bought from them.

    Check what you signed.

Same thing here, car craft presented me in nov 2011 the warranty mandatory and not optional , somehow I was forced to sign the contract even it said it is optional,as they say I need to have the 5 years ext warranty for the same period I took the loan.I did not know cancellation policy it is only 30 days as I though it is mandatory.
As I want to pay my car off, i called the company and the amount of 2000 pounds has been added to my contract , nice ....
I can not cancel the dd as it goes with the loan

    Actions taken:
So I rang Car craft, and they said that I am out of cancellation policy,
I emailed Car craft -same thing
I email the citizen advice bureau-they only give legal advice
I called bank for a charge back on my cc but I am over 120 days
I complaint to ombudsman and I am waiting for reply

Next to do: complain to OFTA
and sue...which I do intend to do as they did not made clear the terms of the contract and they have lied to me about the warranty to get the contract signed.I'll take it to small claims court and submit online. Honestly , if you want to get a finance on the car with Carcraft, please take the contract home and read it carefully or go for a car loan at the bank.

The correct advice is "Do not step foot inside Carcraft".

Why don't the predominately young people that get caught by such practices seach online before buying, what happens to your common sense when faced with a sharp suited grinning idiot sales leech?

I am genuinly puzzled by this, i can understand old people who are not internet savvy getting conned, but come on you youngsters you should be running rings round sharks with shady sales practices and shouting about them from the rooftops.

Carshaft don't sell cars, they sell finance. Very expensive finance at that.

Where others give a free Parker pen, Carshaft throw in a free car, normally one they sold the previous year but have since repossessed.

Didn't we have an ex-Carshaft employee on here a while back who claimed to have sold the same car five times, each time being repossessed and sold again?

Sadly there seems no end to the queue of people completely blinkered into signing absolutely anything put in front of them so long as they get that car.

    +1

I'm just getting back on my feet after a fairly disastrous year last year and i've just started a really good - and good paying - job. Although my credit rating is in tatters it would be the easiest thing in the world to go to one of these places and get a shiny new car to ferry me the 100 mile round trip to work and to impress my work colleagues. Fortunately i'm not that way inclined (granted through past experience of financing cars) so instead i opted to keep the £500 2002 Fiat Marea 1.9 JTD i have and i invested £59 in a good quality breakdown policy (as recommended on MSE) and £14.99 on a clip on blue tooth kit. A regular oil change and its doing my job whilst getting 54mpg. Hold 5 adults easily and has a large boot so its doing everything i need of it.

Plus i'll literally be £,£££'s in.

So coming back:yesterday I have researched Internet and found a contact person at Car craft, apparently was the CEO that I have complained to via email. After sending the email, surprise , surprise,
I have got a phone call today and they are going to remove the extended warranty and do a new credit agreement.
I just hope they will call me back this week.I forgot to ask who am I speaking with as I was at work.

I will be waiting for my new agreement and then remove complain from FOS.
Obviously I will send a big thank you to CEO as it proves that only at entry level, staff is rude and unwilling to help.I guess that your complain just needs to be forwarded to a manager ...:)

What about the interest and payments you have made for the last two years for the worthless warranty?

I wouldn't waste my breath thanking the boss, I would use it warning as many people as possible about their underhanded sales tactics.

That would be taken off from my original contract.
I will see exactly what they have deducted when I will go to them in person.

With regards to warnings there are a lot on Internet...I just had to be smarter and ask more questions when I was in showroom.
The boss apparently sorted out as I got at least a phone call.
Let's see if they call me by the end of the week as they promised.
From phone call to actual agreement is a long way.

PS- then I will have a word with the finance company for advertising 5.4% APR on own website , selling me an APR of 19.5%..

I am not a complainer but when you look at interest at 10 K in five years....you would do the same.

So-I also got an answer form citizen bureau with legal actions and as I said, next to do is -Ombusdman , OFTA or sue to small claims court-for this one I just hope will be a happy story.

    And buyers be aware....

Sales geezer sounds like Authur Daleys illegitimate son.

Did you not read the agreement, how did you miss the almost 4x quoted interest rate?

Personally i tend to read things before i sign, being pedantic like that comes with age.
