    Heart is fine :p Just giving my observations that it's not worth risking your job going against company policy just so you can read webmail at work. Just wait till you get home.

    Also re constructive dismisal if a user is told before they start using the internet that everything is logged and records will be used in any disciplinary procedings then they haven't got a case I'm afraid. But yes, I said it would start the proceding for DP, which is verbal warning, written warning etc etc

    If the alleged email/internet abuse took place & the company did nothing about it until they such time as they had other problems with the employee - I'm afraid the employee would & could argue that the practice was condoned - regardless of signing anything.
    The company also needs to make sure that such policies are fair are continuously enforced throughout the entire workforce - not just against selected employees when & where they see fit or again, they could well be found against in a tribunal.

    So in your example of digging out the logs when they want to get rid of somebody would indeed give the employee a strong case to take to a tribunal.
