In regards to what I’m seeking from this I’ll be honest, when the insurers dealt with the damage to the car they provided the necessary amount to meet the quotation I had provided and an amount to cover my taxi costs when dropping / picking up the car (£20). I explained to both the insurers and the company that I would be seeking some form of reimbursement for the out of pocket expenses I had incurred seeking quotes, having no use of the car for the duration of the repairs and the general distress caused by the incident itself and the drivers follow up actions. It was agreed by both the insurers and the company that these matters would be addressed by the company but after nearly six weeks of emails not being answered and pre arranged phone calls not being returned I finally received a half arsed written apology.

Hmm… company driver tries backing out of a blind junction 200 meters from a primary school, fails to see a car behind him flashing its lights and sounding its horn, causes said driver to have to take evasive action to prevent a serious incident and then just drives off. Driver calls the company and gives his name and number and the reg number of the car he was driving. Just realistic, you have an "apology" for what its worth which is the square root of buggger all. It would be very hard for the company to say, sorry and cut you a cheque for £10, £50, £100, £1,000 for the distress this chap cause you by trying to beat your door down. They haven't, from what has been said, breached any laws by doing so.
Insurance companies are not known for their speed in dealing with claims. Main thing is the car was repaired and no one was injured in this incident...maybe you should of claimed for whiplash and got the police involved for leaving the scene of the and RTA when there was personal injury, and you would of got another £1500 on top from the no win no fee lot.
Maybe the cause of action would of been to sit behind the reversing lorry beeping your horn and let him hit you. He would of known that he hit you at the time and it would of been dealt with as a normal accident but I guess if that happened you would of been accused of driving into the back of him and been stung that way unless you had a witness or one of them in car cameras."Dream World" by The B Sharps....describes a lot of the posts in the Loans and Mortgage sections !!!0 -
If I’d have been chasing a buck I would have, as you say, been better off crossing my fingers and letting him reverse into me. However I was in a small megane and he was in a 7 and a half ton wagon so he would have probably driven half way over me if I hadn’t of moved.
I was extremely angry when it happened but its when the dust settled that the problems started. You start looking at what happened again and the thoughts creep in of what could have happened if my daughter had been in the car, or what could have happened if my daughter had of answered the door. Couple these thoughts with the time and effort it took to simply get the car repaired and the concerns of how the driver found my property and I can honestly say it’s led to quite a few sleepless nights.
I didn’t expect the company to send me a wad of cash but I would have thought they would have offered some form of goodwill gesture to compensate for the distress the incident caused and for my allowing them to deal with it without escalating the matter. In hindsight it would have been easier to let my friends insurance company deal with it but then he would have had to deal with the raised premium on his renewal.
It’s a hard one to call but my solicitor is on the case now0 -
Would take a certain type of person to sit there while a massive lorry is bearing down on them in a Megane! Unless you were a named driver on his insurance and you wasn't driving it under your insurance, they wouldn't of got involved but would of increased his premiums for the privilege.
I am sure if your daughter answered the door he wouldn't of started ranting, shouting or swearing...you have to give him the benefit of the doubt with that one I think.....and unless he was driving very fast which would be unlikely as he was reversing then very little injury would of occurred, maybe a little shock.

I've not read the whole thread but say for example the driver got back to the depot and the Manager said, I've had a call from a man who says you nearly reversed into him. Did you not see his white fiesta, he said he was sounding his horn to alert you. All the lorry driver then has to do is look for your white fiesta on the street and hey presto!Thrifty Till 50 Then Spend Till the End

You and the owner will need to declare this claim/incident to future insurers.
As the deliver company's isnuer paid for the damage then the incident is likely on the cue data base and if you don't declare then cancelled policies/rejected claims and other seriously bad things lie in wait for you when you get found out.0 -

Isn't it possible to obtain/negotiate a payment to cover the costs of any future premium hikes due to this specific incident?0 -
so you essentially swerved and caused the damage yourself? if they refused to assist you, you wouldnt have a chance in court. you need to take no action so all fault is portioned on the other vehicle. good luck thoTarget Savings by end 2009: 20,000

I understand how the driver could have found my house, my point is that after speaking to the manager and explaining the incident I was advised I would next hear from their insurers. It was an unsolicited visit and I was not asked for my consent nor warned that the driver would attend my property, looking at the situation the company will probably try and say it was the actions of a rouge employee but that employee was passed some or all of my details from a manger at the company which I find unacceptable0
