Ico

Hello,

I sent in a complaint to the ICO last week on the 29th regarding an incorrect default on my Equifax credit report.

How long does it usually take for someone to contact you from the ICO to show that they are dealing with the complaint?

Thanks

Why do you need to involve the information commissioner office...? If a default has been placed by mistake on your file then you need to contact the provider directly.
Why do you feel that it is an incorrect default...?
  • Because this has been going on for over two years, the original default was from Natwest in 2004, and then a different debt collection agency has placed a default with out a default date so it will stay on indefinately.

I am fed up of complaining to Equifax who do nothing about it, and the company phoenix recoveries who Equifax say is Arrow global deny it is anything to do with them. I am going round in circles and have been for the last two years, so that is why I am involving them as I am at the end of my tether.

Equifax has got nothing to do with it....they only report the information that is given to them. You need to follow the complaint procedure of the company who placed the default then after that maybe involve the financial Ombnusman....the ICO will do absolutely nothing about it....you will need to have a serious strong case with hard evidence to have the default removed....

ICO can take their time. Don't hold your breath.

It would be worth making a separate complaint via the FOS, as sometimes they act a bit quicker, and can often get reluctant/awkward creditors to sit up and take notice.

  • errr I have a strong case. I have my credit report from 2010 that show the original default from Natwest, and I have my credit report now. Equifax have everything to do with it as they are storing incorrect data on me.

Phoenix recoveries apparently are liquidated, and arrow apparently bought all there debts, but deny they have brought this debt. So I can not contact phoenix as they do not exist.

I have all the hard evidence I need thanks, all I was asking was how long for them to look in to the case.

I would like someone who can answer the question to reply if possible?
  • Thank you Fermi, I will do that as well. what time scale do the FOS take?

    ICO service standards --> http://www.ico.gov.uk/about_us/how_we_work/service_standards.aspx

They do seem a tad optimistic though, and I would not count on being in the alleged %75.

Progress a parallel FOS complaint, and you will give yourself the best chance of getting something sorted relatively soon.

No...you are wrong. Equifax has NOTHING to do with it....they only report the information provided by the lender.

I doubt very much that the ICO will do anything about it.....you will find it very hard to have it removed.

Sorry but I just had some wrong info removed from My equifax file. No other CRA held this information as it was wrong and should never have been on my file. It was a CCJ and it did not show on the registry trust because it had been paid off within the 30 days. Equifax were wrongly holding this information and needed a kick up the ..... to remove it.
