Company breaking terms and conditions?

Right i have a holiday booked with a certain holiday park. Its booked for 6th April and the balance was due 8 weeks before the date of arrival which works out 9th of Feb (which they told me on time of booking)

Well yesterday we went to pay the final balance, to be told its been canceled, due to no payment. trying to sort this issue out with them,
But according to there terms and conditions, payment is due 8 weeks before date of arrival, so they have broken there aggrement in my eyes,

Is there anything i can do about this? i have had not letter, e-mail phone call from the company to say anything about it going to be canceled or that it has.

Can anyone help please with any information?

at the mo we have lost our money payed, and lost our weeks holiday which hurts more.:mad:

    I dont now, as it was on there web sie, you logged in to see the details. which gave you your booking number, payments and due date etc, but wont let me log in now with my ref number.

    When i spoke to them on the phone, she said, it was canceled on the 30th Jan due to no payment.
  • Usually if you book online you would have a confirmation e-mail, if not a letter in the post. There should be something, somewhere in writing which confirms your booking, and the terms.

    I booked over the phone with them, and paided the deposit over the phone, never got an e-mail or letter from them, but all details was online when logging in with ref number they give you on booking.

    even the park i have phoned say it was on the system as booked etc, was was defo all done, but head office decided to cancel it for now reason. even the women at the park cant understand why they have canceled it.

    Waiting for a call from head office, but i can see me phoning them.
    will be giving them to after lunch, or i shall be on the phone to them.
  • Not quite sure what else to check... I've never come across a holiday company before that wouldn't provide any kind of paperwork (whether actual paper or e-mail) when booking. There would usually be documentation of some description giving you the terms of booking, cancellation policy, etc. It may be worth asking them for that.

    Have they said on the phone what date they think it should have been paid for? What holiday company is it? May be worth checking Ts & Cs on their website.

    Yer we have booked with them before, many times, and never had a problem at all with them. They said it should be the 9th (well the holiday park have) head office dont know yet till i speak to them today.
    I have been thro the t&c`s on there site. didnt want to name them really, but its Park Resorts.

    When you book your holiday we require a deposit to secure your holiday, the balance is then due 56 days prior to your holiday start date. Deposit amounts are as follows:

    You are correct -- 56 days = 8 weeks = 9th Feb vs 6th April
  • Thanks for that... I've just checked their website and it does state that balance is due 56 days before arrival, which of course is 8 weeks. I wasn't doubting; it just helps to have something in writing to refer to when you give HO a verbal beating.

    So as far as I can see it is definitely their error, but you already knew that. When you do speak to HO it may be worth seeing if they'll offer you an upgrade for the inconvenience. Do they still have availability for your chosen park/dates?

    If they don't have the dates available, at the very least you'll be entitled to a refund of your deposit, but I would hope they'd offer you something more by way of an apology. Best of luck!
