    First the OP isn't on Income Baased ESA, as they were not eligible.

    Second you are assuming that eligibility for ESA(CB) ceases at the end of the 365 days in the WRAG, it doesn't, it's just entitlement to payment that stops.

    Finally, providing they have maintained their limited capability for work during the 10 years by completing ESA50s and attending assessments as requested, then yes, someone can request an assessment to be placed in the Support Group

    Both you and I are posting the same thing yet for some reason some people are missing the point ..... what are we missing out ?

    ESA CB is for 365 days then stops
    Its only payment thats stopped not the award
    If you ever get sicker then if you prove it you go in to support group
    Payment starts again

    all the time it was not being paid they did pay your NI stamp for oap

    cant dumb it down anymore ?

    wrong and I know more than one person who has been here IF you get into support group they start paying you again as there is no time limit to ESA CB in support group the only thing that has run out is esa cb in the wrag

They of course will argue that their health has deteriorated but at the end of the day the prime reason is to get their money back into payment and not because they need a re-assessment due to a health problem.

    In the meantime they are adding to the already long queue for appeal hearings - selfish???

    People will argue anything to get money as I have found out in life.

  • thanks for all your help.I seem to hit a brick wall. The CAB have told me there is nothing I can do about receiving any money.The crazy situation is that my partner should reduce her hours (which is not an option)to 24 or less and we might be able to claim Inc.based ESA.
  • hi all, I am a bit confused about esa and hopefully you can help me out, I started claiming in Nov 12 and they awarded me £71 pw, I have just received a letter telling me that I am now in the support group and they have increased my weekly amount to £119 pw, I am on contribution based esa so I have to pay for precriptions ect which is about £30 pm so the extra money is really helpful I have not had a medical and really know nothing about esa any info will be greatly received

    Post #5 is incorrect because it is saying post#4 is incorrect, when infact post#4 is correct.

    However all or most subsequent posts correcting nannytone are correct. That is to say that the WRAG tribunal decn cannot be changed, however, if the condition has worsened since the WCA they can ask for supersession or wait for their next WCA, if they get SG or appeal and get SG they will be paid again on ESA C providing the claim never gets closed.

    Post #7 is incorrect for an ESA C claim, making a new claim would be very risky and totally inappropriate.

    post #26 (OP) if your partner reduces her hours to less than 24 hours, you could get ESA IR, however virtually all her income would be deducted from your ESA IR claim, so it would be probably a very silly thing to do, unless it would help in other benefits like housing & council tax.

    You are on the best type of ESA (conts based) in the highest group

    You are correct, you are not allowed free prescriptions based on your ESA award, HOWEVER, you can apply for free prescriptions using an HC1 form - available from doctors, dentist, opticians, jobcentres.
