  • As loathe as I am to agree with Andy, he is actually correct. The OP is still in the WRAG, it is only their payments that have stopped, and if their condition has deteriorated since the previous decision, such that they now meet the Support Group Group criteria, they can ask to be re-assessed and if successful their ESA(CB) will be re-instated.


    and apart from not getting cash what he is still getting is his NI contribution paid towards OAP

    And whilist in wrag although credits only the op is still subject to filling in another esa 50 and maybe another face to face assesment and interviews at job centre

    Claimants only receiving NI Credits will not be called for WFIs, but they will be regularly be re-assessed.

    he is entitled he is just getting no money
    its as I posted might be spelt wrong he can ask for suppersession its not an appeal its him telling them he is now sicker if he can prove it he would move to support group and payments would start again. same for anyboady affected by 365 day rule for esa cb

    seek advice then write to your dep office and put your case you have nothing to lose

    so even if he asks for a supersession and gets placed in the support group .... it would be income based support group which still doesnt entitle him to payment

    yes, but because the OP is in the WRAG he is now on income based because his conts have run out. so a supersession to support group would also be income based
    i dont understand how someone can go back on conts based.

    so if after 10 years of no payment in WRAG, somone could ask for a supersession and go back onto conts based?

    Yes, after ten years they may still qualify for CB ESA if their condition worsens and they fulfil the Support Group criteria. Their Conts have only run out in respect to the WRAG, the fact that they were on CB ESA will always entitle them to receive payment if they are in the SG.

    Nannytone, cockaleekee is correct. Someone who was on contributary ESA in the WRAG and exhausted the 365 day payment can be put into the Support Group if their condition worstens at a(much) later stage - as long as their ESA clam has not been broken in the meanwile (by being assessed by DWP as 'fit for work' or by the claimant discontinuing the claim for some reason). Someone just getting NI contributions paid is still classed as being on ESA, even though no money is being paid to them.

    I don't understand the OP's situation. If he appealed to the tribunal it seems that the DWP decided that he wasn't entitled at all to ESA, therefore he was getting no money. So, the tribunal overturned this decision and awarded him ESA (WRAG) So shouldn't he then become entitled to 365 days of cont ESA? Even if he was receiving assessment rate for a year, he should still receive backpay for the difference between assessment rate and full WRAG rate

    wrong and I know more than one person who has been here IF you get into support group they start paying you again as there is no time limit to ESA CB in support group the only thing that has run out is esa cb in the wrag

    many people are asking for a suppersession after having payments stopped BECAUSE BACK in the support group payments start again

    its a mad world we live in :D
