Urgent help please

Ok so we have finally completed our IVA and thought our money worries were over, today my husband resceives his new tax code and there is a huge deduction for the debt which is part of the iva

This deduction will cripple us and mean we can't keep our mortgage and bills up so will now end up losing everything

Feels like we wasted the last 6 years in the iva as we are in serious trouble again and don't think it should be like this

Can anyone help me please

    Do you own property or assets.
    What is the total value of debts

  • Yeah we own the house and have no debts

    This deduction is from a debt in 2005 which was included in our iva
    trying to lose 3 stone by end of 2014;)

  • If this debt was included in your IVA they should not be making further deductions now! Speak to your IVA company and ask them to contact them on your behalf or send them a copy of your completion certificate

    The house is mortgaged

    I have spoke to the iva but they have just said they paid hmrc their share , the completion certificate isn't with us yet but we have had a letter saying all payments due are now paid in full

  • Thats just not good enough your IVA company should speak with them and sort it out! if they dont you should make a formal complaint, HMRC are bound by the terms of the IVA

  • You will need to write to the IVA company 1st and then if it is not resolved to their regulators. You will find their regulators on the bottom of any paperwork you have received from them.
  • Good advice from ADA.

    Which IVA company are/were you with? You will need to complain to the regulatory body of your Insolvency Practitioner.

    There is some useful information on the Insolvency Service & CAB websites on how to complain.

    Also, you should consider making a formal complaint to HMRC. (Do you have an accountant who may be able to assist?).

    Sounds like someone at HMRC has seriously messed up (a disturbingly common problem in my experience). Having a non responsive & inconsistent IVA provider does not help though.

  • Thats a good point about complaining to HMRC as well - they are not the easiest people to deal with and everytime you phone you get a different answer!
