    Knowing that I really would get onto the council, as it will be much harder to deal with once he sells up. Also, you don't say what type of foundations were dug, but building on tree roots is crazy. Without being overly hysterical here a 10 foot high wall could do a lot of damage if it's unsafe.
    It may also make your house harder to sell in the future as other people may not be so undestanding about the colditz look!
