Returning a used BMW

Hi,

I was wondering if anyone can help me before I try to return my car for a refund. I brought a used BMW 1 series from a main dealer in November, a 58 plate. Almost straight away the car was leaking oil, this problem has now been persisting after going in for repair 3 times. It has most recently been in for repair a week ago where they had it for the entire weekend but the problem has started again. Seems like there could be an underlying problem which they are just ignoring maybe?

Its got to the point now where I feel like I don't really want the car anymore, even though it may seem a small fault its gone too far for me and I would like to get a refund.

Is it worth me going into the show room to argue my case or is it worth doing it another way? Do I have a leg to stand on?

Any help would be much appreciated.

    I would write a letter to the dealer principle and formally reject the vehicle. They've sold a vehicle with an underlying fault which they are unable to repair within a reasonable time and without causing you significant inconvenience. Under the terms of the SOGA you are entitled to a full refund.

    They might try and tell you differently (since they tried to repair).... however read OFT1241 OFT1242.

    This specifically states that just because they have tried to repair it does not affect YOUR right to reject it.

    I'm surprised that a BMW dealer hasn't cured a BMW 1s oil leak. They'll have had plenty of practice.
    If they are a main dealer and it's been back three times for the same thing, it's time to reject and get your money back, because they will be useless in the future attending to this cars other little foibles.

    Maybe send a copy to the dealer principal as well [just to avoid any legal shenanigans(?)].

    Would be worthwhile ringing BMW customer service too. They will put pressure on the dealership to resolve it quickly and amicably.

    I bought an 'approved used' BMW from a local dealer and it turned out there were gaps in the service history. The dealer initially took the 'oh well, sorry about that' approach when i realised some months later, i phoned BMW Customer Service to query what 'Approved Used' meant if service histories werent checked and missing. Hey presto, following morning dealer principal himself on phone and they bought the car back.
