    Sedgetheledge I've been thinking about this as well. I really don't understand why they haven't tried to take you to court yet. Especially in view of the fact that nothing has been paid towards the debt. :confused: It does make me wonder if they would even bother attempting to take you to court after all this time.

    Personally, I would stop corresponding with the DCA's as of now. I wouldn't reply to any further letters and see what happens. You have already said that you are prepared to go to court to enable you to fully put your case across to the judge. So what do you have to lose? It may even work in your favour to let this happen. I would go as far as to say that I don't think a judge would look to favourably on what has gone on.

    We all make mistakes and things happen that are beyond our control. From what you have posted you appear to have done all you can to resolve this. Even down to making an offer that was turned down. It is thoroughly unfair that a situation such as this should shadow your life for so long.

    I do suspect that your case has been passed from pillar to post for so long that the original paperwork has disappeared. Especially as the debt originated from a B/S that was taken over. Do you know who actually 'owns' the debt at the moment?

    In the meantime, as I said to you in a previous post, the CAB is your best course of action. Their advice is excellent and free and you NEED to make seeing them your top priority. Don't go throwing anymore money away on solicitors fees.

    Thanks TAG I will do it THIS week. It has gone on so long, i want to move on in my life and can't with this hanging over me all the time.

    I can't undertand how they can charge me 51k interest...And we paid 39k in payments and they also sold the property for 49,950.

    by my adding up that means we originally borrowed £58,602.60

    paid off £39,429.64
    property sold for £47,950.00 (those were the days)

    So they had £87,379.64 in total from it all at the end of the day. so they have made £28,777.04, i know there will be some interest and a few bits and bobs to add on. but come on now... AND they are chasing me for 34k....

    Someone somewhere has made a serious mistake or i am being done over!!!

    By the way I don't know if you are aware of this but in 1999 the Halifax signed up to an agreement where by they WOULD NOT chase mortgage shortfalls that were OVER 6 YEARS OLD.

    Just thought that might help a bit.

    Just emailed Watchdog and had a search around on internet for Halifax motgage shortfalls, found tons of stuff mainly using IBAS (i tried them and i didn't get very far at the time)

    Hi Sedge, one thing you do need to do is get a very clear and sucinct summary of what has happened financially with a timeline (i.e. amounts borrowed, dates etc). To be frank you tend to talk at length and with understandable emotion but not so clear on the facts. If you are going to reply to them, even more so if you are going to court, you need to be very clear and able to state facts with authority.

    The debt in 1992 was £3218 and a few pennies. by 1993 it was £5,772 in Januaary 2000 i managed to get a break down of the statement.
    Total advance £58602.00

    This I don't understand, if the debt was £3,218 in 1992 why did it increase to £5,772 in 1993 and £58,602 more recently? Or were the £3,218 and £5,772 just the arears on the debt?

  • Hi yes these were the arrears on the debt that muy ex was running up more and more. although i moved out of the property in 1992 i couldn't get him out or my name off the mortage and therefore the debs were getting higher and higher.

    The first letter i have to say they were going to evict him, is dated August 1994 by then the debt must have been about 10k. i Don't think he was finally evicted until 1998 !!! (as i say i have very limited paperwork, and only managed to find out bits and pieces as time went on and i asked for it) and then I had to call them and find out all the details, which i didn't receive an official letter, i just scribbled it down on a letter i received asking ME for a detailed account of my income etc..
    All i have is a folder in date order of all the letters i have received and sent throughout the whole saga.
