Notice to end tenancy - addressed to the letting agent

Hi, I have a quick question.

I just sent two noticies to end our tenancy that read "Dear *Letting agent's name*"

Have I made a mistake in doing this?

Our landlords live abroad and we have never had any direct or indirect contact with them, only the letting agent.

Our tenancy contract only lists the letting agents address as the place to serve notice, so is it ok that I have put his name on the letter?

I can always make an adjustment and go and hand deliver a revised notice on the day that the post letters would have arrived, or do I not need to worry?

    Then that is where you serve notice. The name does not matter povided the tenancy in question (ie your address) is clearly identifiable.

    Our letting agent is refusing to acknowledge that on an SPT we only have to give one months notice.

    His further communications have all been rants (never mentioning that we are actually wrong legally) peppered with personal attacks.

    I don't want him to even begin to try the old "I never received a letter" rubbish...

    Great to know, I thought that was the case but wanted to double check.

    Have you retained certificates of posting for these letters?

    Certainly have, I have proof of postage for the 1st class one and a tracking number for the special delivery one.

    It's just as easy to deny recieving two letters as it is to deny receiving one ;)

    If that's the way your letting agent works I'd be inclined to serve the notice to him in person (and make him sign for it's receipt) or just send it recorded delivery (and hope the Postie gets you a signature)

    Ah, an after thought perhaps?
    You only really needed to send the second one ... and recorded would have done (unless you went for some extortionate amount of additional consequential loss cover too)

    You clearly know better than him. And I suspect don't need the following advice. But just in case...

    * if he rings, don't get into discussion. Just speak over him loudly "Sorry far too busy right now. Have a look at my letter It's all in there!" and hang up.
    * The one month notice law you need is
    Laine and Mitchellv Cadwallader & Cadwallader (2001) (Court of Appeal - tenant's notice period in a Statutory Periodic Tenancy)
    and
    Housing Act 1988 section 21

    Except that both recorded and special deliveries can be left undelivered if the agent doesn't want to sign. First class is the better option here - if the LA doesn't sign for the special delivery then OP can still argue the ntoice was received first class.

    Recorded and special are handled differently. Recorded is treated as first class, but a signature is required on delivery. Special delivery is tracked throughout and not handled as normal mail.
