As far as misrepresentation goes, there is none, as you purchased sold as seen, as far as rescinding contract goes you are well out of legal time frame and have not paid monies owed

We are not prepared to give you our bank details as agreement was agreed as cash so if we do not receive cash payment by sunday will make no further contact other then through a small claims court

No agreement was made in how we pay...

Ok so let her take you to court. I think she's trying to frighten you and has no intention of taking you to court.

Someone on that thread said 'don't pay it' and someone else-the person I quoted said to take photos and point out all the faults to her and how you don't want the kids to get injured and then suggest you call it quits-which means you don't have to pay any more.-She can hardly take you to court for a mis-sold item of furniture, it will cost her money and will be a hassle she can do without.

Yes thank you for that I clearly seen everything there, the majority of people there say I am stuffed.... I don't need this .. what I need to know is about the CCJ hence doing another thread... I KNOW I am stuff ... I am prepared to take it that she has ripped me off and there is nothing I can do about it, what my whole point is about is this CCJ threat.. so please don't keep referring back to that thread as its a different opinion I am after :)

    Depends how she files.

Do you have legal cover on your insurance at all?

... another thought.. if I send her a cheque in the post on monday for £50, first recorded... and its me showing I am still paying... can she even open a CCJ?

If you have legal cover on your home/car insurance utilise it and see a solicitor. If you don't, you should be able to get first half hour free with a solicitor to get some legal advice

The word "pickled" seems quite appropriate here. ;)

Yes, a cheque would give you the proof of payment you need. Obviously an entry will appear on your bank statement.

    Forget the CCJ nonsense.

You have already been told in post #3 that she cannot do that.
