I would name the driver in the first instance but clearly do not know.0 -
Well if you were at her place of work what reason would you have had to go out or lend her the car?
You risk turning a speed awareness course into a fail to name the driver. That would make obtaining insurance difficult for 5 years.0 -
when we are on our dinner break we at times go out to pay bills, her father died 1 month prior and that road is on the way to her mothers or to put money into the bank. There are endless reasons. I have checked credit card accounts and bank statements but there is nothing on them days.0

If you can't be sure, just name the most likely person on the balance of probabilities. Fighting a failing to furnish isn't easy to pull off.0

You could ask Chris Huhne for advice0

You missed the important word out which is registered keeper.
I think it's quite obvious what I meant. It's interesting that the OP has not addressed the question though.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0 -
Whether you remember who was driving or not. You just need to decide who is going to take the rap or flip a coin.
Unless you have the money to employ Mr Loophole. Its unlikely to get any better than just paying up and taking the points or whatever they offer.Censorship Reigns Supreme in Troll City...0 -
Failure to name the driver will see you summonsed for a S172 failure to furnish offence. The bar is very high for a claim that after reasonable diligence you were unable to determine who was driving.
I suggest you contact the SCP in question and ask them if they have any clearer photos to assist the identification process further.
A MS90 offence code ends up on your licence and conviction is going to see you fined upwards of £500 and in insurance difficulty for the next five years. It makes the speed awareness course appear attractive, by comparison.I am a mortgage broker. As mentioned, just name the most probable driver, 99% sure you will be offered a speed awareness course.I hate football and do wish people wouldn't keep talking about it like it's the most important thing in the world0

Yes guys, I think your all right just take the rap. They will offer me a course hopefully.
It would seem as though there is a lot of people who tarnish genuine people, by this i mean they try everything to get out of a ticket and this is like the PPI claim, people knew they had it but jump on the band wagon with greed.
But thats my opinion.
If there is something in place to say contest that you dont know who was driving i think we should put this forward without the fear of standing in front of a judge who can and will impose a higher fee and more points. I believe if someone stands in front of a judge they should either be found not guilty to speak or have the original 60 fine and 3 points at a maximum punishment, we should al be able to defend ourselves without fear.
It seems to me that innocent until proven guilty is a term which has gone out of the window a long time ago.0
