esa stopped now saying overpaid??

    Me and my dad was being mucked about regarding his ESA, so we went to Citizens Advice Bureau, it took 4 hours but they managed to get it sorted after so mainy phone calls to the DWP, being placed on hold for hours on end and then getting a telephone agent who didnt have a clue of what to advise and what was going on the claim, finally something got done. They dont listen to us, so your best of going to CAB as the workers on the phone dont have a clue whats going on. Our advisor really complained and put the telephone agents in right a place, now we have gone back to square of re-applying!...Hope everything works out for you and good luck!
  • ok first of all me and my partner and 2 kids can not live on £140 a week, that is impossible, i have to put electric on my meter which at the moment costs me about £35 a week. I'm sorry mara but you have no idea why my partner suffers from depression and i do not wish to discuss it on here it is very personal, if you had been through the situation that my partner has been through you probably would too. we had a letter back late last year stating esa would be stopping, but also had a call from dwp who advised my partner that esa would run until my partners certificate would run out 18th jan, very confused as it was only when his certifcate run out that he was told he was overpaid?? dont get this as there seems to be a 2 1/2 month gap now so either that esa needs to be run from nov until jan or the jsa (which we have put a claim in) needs to be back dated. we are going to appeal against the decision and if that fails we will back date the jsa i will get more advice next week when we have our jsa interview at the job centre. job centre left us in the !!!! not paying us our usual payment, and yes they just did not pay it so no they havent agreed as of yet to pay it back bit by bit because they stopped our last payment with 2 days warning not really fair!!

    So you knew the ESA was going to stop. Had you put a plan in place for what would happen?

    I have to disagree that it is impossible to live on £140 a week after housing costs and would suggest you have a look at the old style boards on here for some moneysaving meal ideas.

    Have you tried looking at the old style boards on here to help you manage the money you do have. Is the £140 just for food and utilities or do you have debts? If you do, the debt free wannabe board can help.

  • no thanks dont need money saving ideas, me n my partner also smoke so bakki a week comes in at around £30 a week (i know what ill probably get now give up you'll save yourself a fortune) well sorry i have smoked for 14 years and my partner even longer!! i must point out that both my kids are still in nappies which still costs a fortune. yes we knew it would stop and have to claim jsa, but no we didnt realize that they would say jsa would be overpaid since nov, why would we we got told esa would run until januray?? i think u lot are dillusonal if u think 4 people can live independtly in there own place pay for all the bills, and buy food for a whole week on £140, the child tax credit and child benefit is meant to feed and clothe my children for a week not feed us as well, oh also forgot my childs £4 lunch money x2 a week at nursery which the goverment dont fund either because its a nursery place not at school.

    So are you happy to put your habit over and above your children's well being? You need to smoke so they can't eat? I assumed you and your partner gave up during your pregnancy so I am sure you can give up again now you cannot afford it. It is terribly bad for the children, you know.

    Why are they in nappies if at nursery? Are you on a govt assisted programme? If so ask your social worker for meal help at nursery.

    Other than that someone I know who paid large tax for years has just been told they can survive on £200 pw with more children, full council tax and full housing to pay. That's the thanks for paying tax, many are feeling it, they hit great ideas from the old style board.

    First of all it looks like you were given bad advice when found fit for work in November. You should have either appealed right away, or signed on for JSA right away. Whether being given this advice will contribute to you being able to backdate the money is a different story. You may still be able to submit a late appeal, but don't know the ins and outs of it. The fit note would only have covered him up to January if he was still claiming the assessment rate I believe or sending in an appeal.

    As for the housing benefit continuing... It won't unless you notify them. Usually when a benefit stops so does the housing benefit and you have to notify them of your change of income.

  • my oldest is 3 1/2 we've been trying to potty train him for about 7 months now, we thought we were getting some where but just going backwards again, its not been easy, we have and still try pants but its just not working so maybe hes not ready i am seeking further advice my youngest is 19 months (hes not in nursery yet). no i dont have social worker. i've found a letter dated 15th dec, it states the amount of esa we are entitled too, the deductions, and info about an arrears payment which was paid allthough it says on the letter it was witheld because of an overpayment this is very confusing how come they sent that letter stating the amount of esa we were entitled too if we weren't and it was suppose to of stopped in nov?
