DLA - Can you help me please....?

    They get in touch with doctors that treat you to find out more about how you are affected.

    They may choose to get in touch with doctors, if they believe they cannot justify turning you down without it.
    Do not simply assume that they will get in touch with your doctor.

    i have a claim for DLA in process... been ongoing for about 2 months, they have contacted my doctor twice for information... (my doctor has practically sent my medical records since i was a teenager back to them) - looking back, my issues with my back mainly began when i had some idiot come speeding up the road and smack into the back of my car ... at the time i felt fine etc and no comp etc was even looked at (i just wanted my car fixing!!!) - although, i have had problems with my knees since i was a teenager...
    (i will admit... problems which were most likely caused by me being a severely overweight teen)...

    still not heard back from DLA personally though (except for a letter twice stating "we are sorry its taking so long to process your claim.... we have had to request further information from your doctor")

    ahh well... - my claim is based mostly on mobility...

    TBF, i struggle quite a bit. but it would help so much if my local council would simply grant a blue badge on drs referal etc... but their criteria is that you need mobility higher rate DLA or no legs/arms to qualify.
    - even if i pay for parking in town, there are no spots to park... but disabled badge holders can park smack in the centre of the high street - which is always empty.

    What he should concentrate on is sorting out his knee problem, not trying to get more money from tax payers. It is ridiculous that he left for three years to push for an MRI. It might very well be that all he needs is some physio, or some injections and he will be fine. Or he might need an operation and then he will be back to his normal self.

    Either he has left it be for too long and that his fault, or the NHS is failing him and his energy should be spent on making sure he is getting the treatment so he can resume with his life.

    You don't always need DLA to get a blue badge, you can apply to your local authority and they could give you an assessment themselves to see if you can have one.

    If you go here. https://www.gov.uk/apply-blue-badge and put in some details then it will tell you the procedure of your local authority.

    I think the comments about leaving things too long is unfair, if you read my post you would see only more recently have things got much worse.

    Thank you to everyone else for your constructive support and ideas, I think I'm going to advise him to keep records in case he needs to make this claim.

    I see a claim is a must before April too?

    DLA is being stopped and a benefit called PIP put in its place, after March 2013 new applicants will be assessed for PIP. The mobility criteria for PIP are much more stringent than DLA.
  • I'm not sure if he should claim now, as he will be expected to repay what he has claimed, from the compensation money.

    What I didn't think was fair that he has to pay out of his award, even though this is an additional cost for mobility, surely the respondent should just pay the additional amount to cover the extra costs inured for the mobility aspects.

    I can see why DWP want the money back, that seems fair too.

    Not sure what I should tell him to do now really, because he maybe should just get a car and pay for it, settling any debt or savings used with the compensation.

    If he meets the criteria for getting the mobility part, he should claim it. They can only say no and he'll be in no worse a position than before.

    I didn't think DLA could be claimed back from any compensation payment, I thought that was more ESA and sickness benefits tbh. But I could be wrong. Edit: And I'm wrong :) But if the forms are all done correctly, then the personal injury payment should more than cover what's received in DLA.

    Either way, if he meets the criteria, he should claim it, it will not put him in a worse position than he is now.

  • Thanks for the advice, I'll let him know. I was just thinking I'd hate to go to court and then win, only to give all the money to DWP because I have already have it. So I guess he may just feel the same too, so would anyone else? Anyway thanks for all the help, it's been great!!!!

    The compensation award should take into account any sum that would be reclaimed by DWP.
