  • Hi Guys,

    I rang them up this morning regarding this issue.

    I swapped over from T-Mobile to Orange about 3 months ago. I paid what I though was my last installment and then canceled the Direct Debit. There was still one payment owing to them however, which was not paid. So they passed the £40 debt on to this company. It may well of been my fault, but I did not have any notification from T-Mobile.

    Thanks for all of your help! It's a big weight off my shoulders.

  • I've had the same letter come in and i no that i have no outstanding debts but im gonna ring them to find out what this private matter and they will no about it if its a load of crap!!
  • I've just received a letter from Robinson way limited saying my debt has been passed to Buchanan Clark & wells. Almost £500. Ain't got a clue what it's about. Phoned Robinson way and they told me the debt comes from 'ex shop direct' who are part of some catalogue that I've never had or bought from.
    No chance they're getting money from me. I may ring them tomorrow but more likely I'll write to them Monday after reading other people's posts

    I recieved a letter from them today, worded exactly as the OP, for an address I moved out of in 1999.

    Suffice to say I shall be ignoring their letters until they provide specifics, then the "statute barred so sod off" letter will be sent.

    Have to say, I was tempted to ring them...
    I spent 25 years in the mobile industry, from 1994 to 2019. Worked for indies as well as the big networks, in their stores also in contact centres. I also hold a degree in telecoms engineering so I like to think I know what I’m talking about 😂

    These DCA`s send out hundreds of the same computer generated template letters all the time, to be fair, the OP was desperate to know what it was all about, and against good advice, phoned them, it turned out to only be a £40 debt, which is of little significance to the DCA.


    However, if it had been a larger debt, the DCA`s collection activity would be far more aggressive, and she could of opened herself up to a whole world of hurt.


    Best advice is to deal with ANY DCA in writing only.

    Well, seeing I moved out of the property 15 years ago I'm pretty sure whatever it is - it is statute barred ;)

    Update - they sent me a letter dated 20th stating it was from Vodafone for £21.05.

    Sent them an email stating the account would be statute barred as I moved out of the property over 14 years ago and to basically cease and desist.

    Today I get a text to my phone advising me they have urgent info for me and to click on a smartphone link, which I did. Answered a few questions and - there it was. I was hoping it was a message saying your case was closed, however it was a request for payment.

    So I emailed them again today asking them first of all - how did they get my mobile number. Secondly whether they read the first email and thirdly reminded them that I ain't paying it as it is statute barred.

    I know it's only £21 and I could pay it dozens of times over, but it's not the point. Vodafone can't be that bothered as I've had 3 contracts with them in that time and they probably sold it on 12 or so years ago. If Vodafone really want it I'll gladly pay them directly. I'll never pay a chancing DCA company who paid probably less than a quid for the account.

    I'm looking forward to their next reply :)

    I often put the words "Without Prejudice" on the top of legal type documents just in case. Also "E&OE" at the bottom.
    "Without Prejudice" on anything other than an informal offer of payment with court proceedings underway (or imminent) is generally inappropriate.

    The effect is to disbar that communication from legal proceedings. This is definitely not what you want for anything that could form part of your defense.

    Sorry if this is a bit off topic, but I felt that I should comment for the wider audience. Using those words is often misunderstood and just as often not the right thing to do. And it could have weighty implications.
