Working and claiming DLA?

Hi, I'm completely new here. I have a lot of things I'm trying to sort out in my life right now. I thought I'd try to start here.
I'm working, but I'm in the process of claiming DLA. Also, my parents are claiming benefits and a job in my name. Not 100% sure what benefits they are. I think it's something disability related. Am I doing wrong in trying to claim DLA for myself?
I'm in somewhat bad debt, well bad to me because I have NO money.
Thanks for reading

No. I'm not on any benefits, personally. They are claiming it for my mum, but it is in my name and my bank account.0

You need to find out exactly what they are claiming.CondemnedElf wrote: »No. I'm not on any benefits, personally. They are claiming it for my mum, but it is in my name and my bank account.
The most likely scenario:
You have a claim for DLA, and they are the appointee dealing with this, and they are claiming carers allowance on the basis that they are caring for you 35 hours a week or more.
You do not want to make a fresh claim for DLA, but to get the DLA paid directly to you.
A fresh claim for DLA may reduce or eliminate your award.
DLA can be extremely complex to apply for, and you may not be aware of all the work that's gone into prior application.
You need to sit down and discuss what is happening, and what they are spending the DLA on, before making this decision.
If you are now capable of dealing with the benefits yourself, then you can get them removed as appointee.
To repeat - a fresh application for DLA may be treated as if you are reporting a change in your condition. This can lead to you being reassessed and no money being paid.0 -

My first thought was that one of your parents gets DLA and you are claiming carers allowance? But that depends on how many hours you are working and how much money you are earning?
Whatever, if the claim has been made in YOUR name and goes into YOUR bank account, it is YOUR claim not theirs. And in order to make that claim, they would have need information from you in order to complete the application form.
So the first thing do do is to find out exactly what you are claiming for. If you tell us how much money is going into your bank account and the reference from the sender - this will be on your bank statement - we can probably tell you what the claim is.I'm a retired employment solicitor. Ok, first off I'm not wanting to claim DLA to help get my out of debt. I'm wanting to claim because I'm ENTITLED to it. Tyvm.
My dad is claiming as a carer for my mum for over 35 a week and a job somewhere else that is £50 p/w, but they have too much money is savings so they asked if it could be in my name and for my to open a bank account for them. Stupid, I know.
The benefit money is around £1,300 per month after tax. I can't tell you what the reference name is because I closed one of my bank accounts down because I realised my parents can fully access it. So I switched banks.
I'm 27 years old.
I work, but I only earn around £200 per month.0 -

OK, one thing at a time.
DLA. If you think you meet the eligibility criteria then you can claim it yourself. It is not means tested and therefore any money/savings in your name will not be taken into account.
Parents Using Your Bank Account for their benefits.
If your parents are claiming means tested benefits and have savings over the limit then this is fraud. You need to do something about it.
I am not sure how they can have their benefits put into your name. I would have thought this would have raised questions. Or did you mean that their savings are in your bank account?
What ever way round it is you need to do something about it.
Only earning £200 a month suggests that you should be on some sort of benefit. JSA? ESA? Have you applied for either?
How many hours are you working? Can you work more or is your illness/disability preventing you from doing so?
Sorry for all the questions. Just trying to get you your entitlement.:)
PS And how can your parents access your bank account?0 -
No, the benefit money is in my name and goes into my bank account. So I'm assuming ''I'm claiming'' these benefits for my parents, because their savings are too high.
I was applying for JSA, but my dad had a go at me because 'it could effect him and everyone else' he says. So I got bullied into withdrawing my claim.
I'm only working no more than 10 hours per week on minimum wage. My employer doesn't have the hours available to give me more, but in reality I can't cope working right now because of my mental health issues.
I open the account in my name and gave them the bank card.
Sorry this is so complicated.0 -
sounds like your parents may be pulling a fast one and using your name to do it, you really need to sort it out cos it will come back to haunt you sooner or later. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0
