Dell - Can I take them to the small claims court?

    Exactly

    I use my home address as business address as well that's why I am here
    but looks like I have no chance other than avoid dell again in future

    When ordering there is no way it asks company name
    even the invoice they send its not even mentioned there

    but their payment system would log it as a business as it was paid using a business card, so in Dells eyes and even in the eyes of the HMRC the item is a business purchase, so if you are VAT reg. you could claim VAT on it.

    Last 2 systems I bought under business name
    That's why they already knew that I am their business customer
    But this time during boxing day they have some good offer so bought it for purely personal use and not even given my VAT number but I messed up

    How would Dell's system know the OP used a Credit Card that belongs to a business?

    Using a business card does not mean its a business transaction necessarily, it would all depends if, on the tax return it was submitted as such.

    There's the problem then, no conspiracy theory's from Dell, just that you accidently used the login which you originally had setup as a business.

    To an extent I would put this down to Dell's systems being flawed allowing you to order from the Home site with the business details. Given the system when you order through the home site doesn't allow the entry of a company name.

    Given you want to return the item this should reset the tax state of the shipment, I think I would go after this from the aspect the Dell site does not allow you to edit or remove the company information when making a home purchase on a pre-setup user ID.

    you could say the thing they why can a home user order from the business section. the answer to this the deals are better through the business section

    I don't think so...If I used my company credit card its in my name, so how would Dell know that its a business card?

    If you read the terms of a SMB site purchase they detail your rights.

    Now back to the OP, they need to ask Dell about why its applying a company name in the back end when all invoices and indeed the section of the site it was purchased through do not allow company details to be entered.
