Dell - Can I take them to the small claims court?

Hi
I recently bought a Dell laptop from Dell Home site
While ordering I given company name for reference

Now Dell refusing me to accept the return based on Home returns policy (which is less the postage charge)
but they are saying they want to do this based on the business site which is 15% restocking fees

Can I take them to small court?
Any Advice?

  • Anyone can take anyone to court - you dont choose which court or track with in the court it gets allocated to - this is the benefit and pain of our legal system

    Evidently if the claim is totally spurious or you have not made enough efforts to settle out of court then you may end up footing their legal bill but that doesnt remove your right to issue in the first place.

    By the sounds of it, you ordered an item saying it is for a business but now you want to return it you are stating it was a consumer order instead to benefit from consumer law which may not protect you as a business?

    so you used your Company name as a reference and want to return the item ( whay and wants wrong) and they wont accept on their Home return and say you have to accept business rates.

    Whats the issue, you ordered as a business and not a home user, so you to Dell are a business user so they will use their business system.

    This is not Dells fault, you are the one ordered it as a business through a business and want to send it back as a home user

    whats this got to do with small claims court.

    OP gave his business name which would show on invoice so to Dell he is a business user and not a home user.

    I imagine when he order he ordered through the small to medium size business section and not home section

    i just said i imagine that as this to dell you assume he was a business. also giving dell his business/company name what is dell to imagine. yes its an assumption until the OP replies back

    i am a dell user and have been many years and they are not always perfect, but what company is. I know that you can get a better deal under the small business section than the home section

    Seriously, how do you keep putting up replies where you join dot one and two and get to dot five?

    The OP told us he gave the company name as a reference. Not as the company name.

    The reason why I asked is because the HOME checkout on Dell does not provide a field to enter company name.

    Yes and when you buy from the SMB section you are required to provide a company name (even if a dummy) something you cannot do when you buy from a dell home order.

    It does appear that you have presented yourself as a business purchaser.

    As you also used the business's credit card, it seems that the business actually made the purchase, doesn't it?

    However, if you are a consumer, that is a fact.

    This then could be the issue as it would show up with dell as being paid by a business.

    Call them and explain this clearly and calmly. They are usually good at sorting issues out.
