Laptop: Does this count as not fit for purpose?

  • It's a nonsense to suggest just because it can't play the games it's not fit for purpose.

    Why is it nonsense?
Surely if the main reason for making the purchase was to get a computer for playing games and the one purchased isn't able to perform this function, this means that it's not fit for its intended purpose.
Just because it's recommended for 2gb it doesn't mean 1gb wont work, the OP's friend should have done their own due diligence as to whether or not the spec was suitable for their requirements

But Microsoft don't simply recommend 2GB of RAM. They clearly state that it takes 2GB of memory to run the operating system.

Only if Argos were made aware that is why the laptop was being bought.

Its akin to me buying a small family car so that i can win the Nascar rally.. if i fail to win the race would i be entitled to a refund?

However, in this case i think if the laptop is not powerful enough to run the operating software it is a good reason to get a remedy (although not sure if after so long the OP's friend will have been deemed as having accepted the laptop).
  • I totally agree that's it's far to late to reject the laptop, but if the problem is pointed ou to Argos, they may well make a contribution by way of a gift voucher.

Even though it wouldn't be fair to expect the car to win a rally, you would still expect the engine to be powerful enough to make the car suitable for everyday usage.
As the laptop is currently configured, the lack of memory appears to mean that it's not suitable for general use.

no i am just making a general statement which if you had not guessed this is a public forum and statements can be made. if they bought the laptop and it stated 1GB then whats argos going to do. they knew what they bought and it is fit for purpose.

You can buy a top of the range 10GB system and find that does not work for some software/processes.

Everything but the bold part is true. It is also entirely irrelevant to the OP's friend's issue. The bold part is incorrect.

if they looked in the argos book or argos online and read the description then they knew what they were buying and it the laptop works and carries out simple functions then its fit for purpose (maybe not what the OPs friend wants) but still a fit for purpose laptop. Argos would not be aware of what you want the laptop for.

Depending on what facebook game she's playing, I dread to think how a celeron would handle the games. My mum has an I3 with 4gb RAM and it groans under the strain of pioneer trail because it's so poorly optimised, and facebook games are getting more sophisticated all the time. She'd need some form of graphics card, or at the very least an intel 4000 onboard graphics.

Thank you for all the replies. I didn't mean to cause such a stir though :).

I agree with both sides which is why I posted. I feel that my friend should expect a certain level of usage from a new laptop. For a lot lower price she could have got an older PC running XP that would have fulfilled her needs the only reason this laptop is not in my opinion is because of the operating system being too much for the hardware. Obviously Toshiba knew this laptop would not sell throwing XP in it and also seeing as it seems to be discontinued everywhere unlike the 4gb versions they realised it needed more ram.

However I also feel 6 months is too long and she should have taken it back right at the beginning and got the refund but like I mentioned she did but was lead to believe it was a software issue and because shockwave kept crashing she believed that was the culprit and was unable to remedy it. If this had not been said to her she would have had the refund and purchased a different laptop.

Still doesn't help where we are now. She is going to email Argos and see if they will do anything and failing that I don't know what she'll do but I would hope she would just let me install the RAM :). If anyone has a good template or a nice way to put this to Argos please let me know and as always I will pass it on. Thank you.

Thank you to all that have responded. I'm amazed by all the help. Thank you.

Thank you everyone for your advice. I think it is always nice when someone posts for help to return with the outcome. So for those that are interested here it is :).

My friend returned the laptop to Argos as they wished to have it sent off to be looked at, however their systems were down (I wonder if they required more memory), as such they very nicely offered to simply replace or exchange the laptop. There was not much in stock but she opted to add £20 a get a new laptop. I've given it the once over and she's done very well. Much better spec than the original and enough memory also. Running windows 8 but can't have everything :).

Again thank you for your help and advice.
