Money claim for a flight

Hi, I flew with KLM in September from London to Miami and I booked my tickets over the phone using some vouchers that KLM gave me for a delayed flight in the past. They took my card details to pay for the rest of the money that the vouchers weren't covering, and everything was proccessed fine. I was surprised that they didn't take the money from my bank account and I phoned twice to check that everything was fine, as I was worried that the tickets weren't valid or not proccessed until payment was taken. But the guy on the phone said that payment was already collected and the tickets were valid and proccessed, ready to be used.
I flew and KLM never took the money for those tickets from my card though I phoned them twice to tell them before flying.
Someone from KLM phoned me today after 5 months, claiming the money for those tickets, although they admited that it was their mistake proccessing the payment.
What shall I do? I didn't do anything wrong, it was their mistake, and I never refused paying or gave them false data. Can they claim the money now or shall I ignore them? I am not happy with that after all this time, specially not being my mistake. I just need to know if they can legally take any action to claim that money or if I can get away with it. They should claim the money to the person making the mistake and proccessing everything wrong, not me as I didn't give them false card details or refused to pay at all.

  • They have 6 years to claim and so 5 months later is well within the limits.

    The fact it is their mistake simply makes it a case of you needing to pay whats owed rather than it being a case of fraud. Given it is their mistake they should be lenient over payment terms if you cannot afford to pay it all immediately now - certainly the courts would be if you are truly in financial difficulties.

    You went on the flight so pay the money.

    Although you should complain when you pay and they may give you a voucher off your next flight.

    They have issued you an invoice for services provided as many businesses do....so yes you should pay. A lot of businesses will provide goods or services and then issue an invoice.

    KLM could simply have debited your card without letting you know.

    Visa card regs state a retailer has 6 months to process the transaction (clearly the sooner they debit the sooner they get their cash)
    After 6 months it can be charged back as a late transaction.
    Be aware doing this WILL see them take you to court as you do owe the money.


    Ignore them at your peril, as they will simply debit your card (Stopping it won't make any diffrence)
    If you have not got the funds then your bank will charge you for being overlimit.

    They do not have to take any legal action. They already have the right to it.

  • miduck, I thank you for your reply, but I just need more opinions about it or somebody with the same issue. Obviously I don't like what I am reading, but I will have to do what I need to do.
    I know that I didn't pay for my tickets and morally I should pay for them. But in real life mistakes like this happen, and I was thinking that if you go shopping and the assistant doesn't scan an item on the checkout or makes a mistake with the final payment and charges you less, and you leave the premises, although he realises of the mistake, it is very very unlikely that they claim for that to you.
    Or if you get a parking fine from a private company, not the council or the police, and you don't pay for it, you get away because thay will never take you to court or the chances are very few.
    That is all I was wondering about my tickets, that I might be lucky and get away with it, because they will never be bothered in taking me to court for that. But if the case is that they will take it as far as they need to get my money, I will obviously have to pay.

    Your missing the point. You used the service and therefore have to pay. They will just take the money using the card details you gave them. They made a mistake which they are now correcting.

    If they still have your card details they don't need to take you to court because they can simply put the payment through now, so you're fighting a losing battle.

    First of all, they don´t have my card details. Everything was booked over the phone and although I provided my card details and everything required, the guy who processed my booking, put somebody else´s card details apparently, and they don´t have my card details I assume, as like all of you mention, they can simply debit the amount straight away.
    So, first point, they don´t have my card details I think.
    And second, I have been looking through all my e-mails and I have a receipt for my flight, sent by them, stating clearly the amount and method of payment, and that the money was collected from a card (not mine obviously).
    If I have a receipt for my flight, apparently I paid for it, and I don´t think that they can claim that I didn´t know. It was their mistake and I can´t see how they can prove that I didn´t pay now.
    I might be wrong and some of you can still say that they can take me to court and prove it. I wonder if with those details, you can throw more light into it, or is it still straight forward for you and I have to pay anyway?

    People who are trying to weasel out of paying the money they owe are never popular on here. You know you didn't pay it so just pay it.
