probation termination advice

Hi all.
My job was terminated recently and i'm planning to appeal. I asked for a copy of the minutes of the meeting which was held in the presence of my line manager, Hr and myself. WOW, is all I could say. I've been sent a document which lists about 3 times as many failures as were mentioned in the meeting (one of which is an outright lie) and I aparrently agreed to everything or if not acknowledged it (if you believe the minutes).
What i'm wondering is if right from the off the company hasn't performed it's duty properly. For one thing I was given my invite to the meeting half a day before it began despite my LM having it two days prior. I was given it and told "Sorry I meant to give you this since Monday". I asked if I needed to bring anything or get anything ready and was told, "no it'll be fine, just bring yourself". Really?
Anyhow, fast forward to the meeting. As far as I understood it, it was going to be an end of probation meeting. When I got in there I was told it was a formal meeting. Okaaaay.
What then followed was a conversation about why I was being dismissed (performance) which was pretty jokey in itself and my being told I would pretty much best be leaving the premises immediately after the meeting had finished.
Now that the detail is out of the way I ask you am I not right in thinking that if the meeting was a dismissal meeting that I should have been given a clear indication of the nature of the meeting and in good time to prepare myself?
Secondly isn't there supposed to be a third, "independent" party taking minutes to stop the sort of thing happening that has happened here i.e me receiving minutes listing several faults aimed at me which were not mentioned in the meeting with neither party being able to prove what was actually said.
My one concern is that it's a probation period and that as such my grounds for appeal are limited.
My appeal will be based on one of these grounds but I don't have the space nor inclination to post it all up
.
Thanks for listening.

If you hadn't been there 2 years they've actually went beyond what they needed to do - they could have sacked you on the spot, no meeting, no "notes" no niceties, just there's the door. Now that blunt bit of information is out of the way...
What do you hope to gain from any action? Realistically do you WANT to work for a company who have basically made stuff up? Do you have tangible proof that you were not under performing? Do you genuinely think the appeal's going to achieve anything other than wasting your time? Given you've mentioned "probation" it would allude to the fact you've been there a short period of time, thus you don't have any rights to unfair dismissal unless it was for a reason which is protected by law. (which it doesn't sound like)
I think you'd be best shaking this one off, chalking it up to experience & moving on with your life, because an appeal at this point in time is a waste of time & energy.Retired member - fed up with the general tone of the place.0 -
Sorry to disagree bluenoseam.
I do have a very good reason which is protected by law which is exactly why i'm appealing (That and the bundle of half truths in front of me which have incensed me to do so).
Had you read my post more thouroughly you would most likely opened with a different statement. You're afforded the same rights as an emplyee with over 2 years service if a certain criterier is met and I meet it and then some. Ok.
You've not even managed to answer what was asked either. There are two questions and a thought process as to why they are being asked clearly defined before they were asked.

Perhaps you could elaborate on why you have the same protection as someone that has been there two years? I read your post the same way bluenoseam.0 -
How long have you been there?
What is the protected characteristic that you have that means they have discriminated against you for? If that makes sense...If you haven't got it - please don't flaunt it. TIA.0 -

Me too, I also understand a probation period to be a time frame in which you prove yourself as a valuable employee and permanent employment commences from then. I have known probation periods to be both extended and to be waived.
If the company decide not to employ you after the end of the probation, for whatever reason, that they are entitled to do so.It's taken me years of experience to get this cynical0 -
Indeed - that's the whole point of them!
Seems the employer gave the OP a little too much feedback when they could have just said 'get your coat'.If you haven't got it - please don't flaunt it. TIA.0 -

Unless you have been dismissed for a reason such as sex, race, gender etc then there is from what you have said very little you can do about being dismissed.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -
OP, please be a little more courteous to people who are trying to help you.
It costs you nothing and other posters will hesitate to help you.
You are getting excellent, and might I add free advice.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Im also interested to hear what this protected characteristic is.0
-
Exactly - You make no mention of it and then jump on the first person who tried to help for not noticing it... It wasn't there?!*** Thank you for your consideration ***0
