IbJSA PASSPORT TO FULL TAX CREDITS OR NOT?

    yes it does say that doen't it.

    I wonder if claiming DLA & CA its different?


    People are often confused about IS because it usually says online that you can claim it if you are 'on a low income'.

    The truth is that IS is given for specific sets of circumstances where JSA or ESA is not relevant.

    You cannot claim both and you are on a joint claim for JSA so will not be entitled to IS.

    Ive just had a call from the welfare helpline, he told me to phone HMRC back as in there TC600 notes it does say that if we are claiming IbJSA then we skip section 5 about our income and go straight to part 6 which is how we'd lie to be paid...and this should give us Tax Credits.

    We have seen this on here a few times. Problem usually appears when you are given cont based with income top up.

    Tax credits see cont based (which it is) there have been some cases where the op has said TC wouldn't over rule and use the income top up, and others haven't had an issue.

    Just keep trying to get them to understand that cont based with income top up etc. their systems just seem to do one or the other not a mixture.

    Because I dont understand much about JSA I said he is on IbJSA which he is, but should I have said he's on both 'contribution & income based?' (which I suppose he is if hes paid enough NI) Would this then be allowed? im phoning them in the morning

    What does his jsa award say? As you can see the problem arises as his previous income means he is on cont based - the TC will see this from your previous claim etc.

    Normally they are placed on cont based automatically if entitled. So you need jc plus to swap to ib jsa or TC to acknowledge the income related element.

    Ie you are put on cont based for 6 mos then swap to ib.

    So you are a mixture. That is going to be fun. There is something that can be done with mixed JSA but you may have to ring back a few times before an operator works it out.

    I have said to them its Income based (even though now I have learned its both), they still said NO to tax credits, I guess I have to phone them again and state in their notes on the tc600 form it says YES.

    This might be the crucial point. Is that since April and has he received any redundancy.
  • Statutory redundancy of 3k (this went on a van & tools ready for when he gets s job) which is included in the 36k overall salary.

    I was told salary is ignored once you are claiming IbJSA

    The problem you have is this

    Irjsa is under £111 pw income.

    You have £60 and he has £71 (cont based jsa is treat as income) so effectively you are over the cont based plus disregard. Hence the between two systems.

    As I said - what does his award say? Is it a joint income based award? Or cont based award?
