  • Yes there's a 3 month gap - letter is dated 14/01/13, for an offence at 13 26 33 on 28/10/12, caught by a static camera.

    Does their time delay in issue the NIP invalidate the charge? I certainly didn't receive anything within 14 days.

  • I was the registered owner and keeper. My father is the driver now, since about 3 weeks ago, and got insured for the vehicle, as I intend to sell it to him.

    My insurance address was in Scotland at the time - but I would have got any mail that went there. The 'offence' occured in Northern Ireland.

    Where was the car registered at the time of the offence and when did you move from Scotland?
  • Car registered in Belfast and taxed there too, at a Belfast address. Insured at an address in Dundee.

    They would have no reason to send anything to Scotland
    As long as the vehicle was registered to you, you may have a defence. A nip is deemed to be served two working days after its posted, you will need to dispute this at court.

    Not in Northern Ireland though. The requirement for a NIP seems to be in Section 5 of the Road Traffic Offenders (Northern Ireland) Order 1996 and speeding is covered by Section 43 of The Road Traffic Regulation (Northern Ireland) Order 1997. I've half a feeling that the requirements for signs might be slightly different as well, but confirming that would need more searching than I have time to do at the moment.

    Given it seems to be fishing in a barrel here I'd suggest you head over to pepipoo OP as there might be more guidance there on any issues the NI location might throw up.

    The Road Traffic Offenders (Northern Ireland) Order 1996

    States :
    Requirement of warning etc. of prosecutions for certain offences
    5.—(1) Subject to Article 6, a person shall not be convicted of an offence to which this Article applies unless-

    (c)within 14 days of the commission of the offence a notice of the intended prosecution specifying the nature of the alleged offence and the time and place where it is alleged to have been committed, was—

    (ii)in the case of any other offence, served on him or on the person, if any, registered as the keeper of the vehicle at the time of the commission of the offence.
    (2) A notice shall be deemed for the purposes of paragraph (1)(c) to have been served on a person if it was sent by registered post or recorded delivery service addressed to him at his last known address, notwithstanding that the notice was returned as undelivered or was for any other reason not received by him.
    (3) The requirement of paragraph (1) shall in every case be deemed to have been complied with unless and until the contrary is proved.

    So still needs to have been served within 14 days.

  • Thank you for your advice - now tell me, how do I disconnect the stovepipe from a waterford stanley oisin, in order to sweep a clay flue? I've tried pushing it farther up the flue but haven't been able to get it up, and can't remove the stove from the fireplace with it in.

    My only alternative to sweep my flue then would be the chimney if I can't get the stove pipe out, simply because I can't remove the baffle on the inside of the stove. I believe it is warped after 1 year's use - indeed 2 of 3 of my firebars recently fell to bits.
