Advice needed on appealing parking ticket

    Essentially what the council are trying to claim is that where the Saab and Transit are parked is in fact pavement and not two car park bays. However it appears that there is a white dividing line between the saab and transit, which extends right to the kerb and which to most people would indicate that these are parking bays.

    Suggest you get some photos of the bays (preferably empty)

    What evidence do you have you were in the car park, did you take pictures, did they take pictures ?
    do you have a pay and display label.
    The contravention does not add up.
    Agreed Pepipoo is the place, but it is hard to pick out the genuine advisers from the Trolls who are just glad you got a ticket.
    Run both usually obtains best results as what is correct will be duplicated.

    The contravention says he was parked in the street outside of prescribed hours.
    That is not the code for parking on a kerb, nor in a car park.
    What is the location given on the PCN as ?

    It is a bit confusing isn't it ? To answer your questions:

    Yes I took photos of where my car was when I got the ticket, so in my photos I am parked where the Saab on the street view photos is parked. I am within the bay, wheels nowhere near the kerb. I would post the photos but I'm wary of doing this as my reg number is visible.
    I believe they have taken photos, as in the envelope that I got the ticket in there was a little business card that says the ticket was issued by a civil enforcement officer wearing a body camera. But I get what you're driving at, I should ask them for a copy of the photo.
    I didn't have a pay and display label as it is a free car park (I know, I can hear you gasping - they do still exist !)

    On the PCN the location just says "Fletcher Street Little Lever".

    Drilling it down, The Kerb issue is not that material, the "officer" is claiming you were parked on the street itself , not the Kerb, not the car park.
    If they have pictures you need them !
    Also explore what restrictions are in force on the street he claims you were parked on.

    Bolton do not issue code 62 (pavement parking) as such, but since a pavement is part of the highway they issue code 01 where there are restrictions in force

    Well if that is the case, thats the adjudication won, they have to use the correct code.
    To be honest I can see the council sticking to the guns on NTO formal appeal and then not offering any evidence for adjudication.
    They Have these little honey traps that get ticket quota's in, but once ruled upon by adjudication the Golden goose is dead.
    Most people do just pay up.
    Would they risk it to adjudication ? when they can let one go and carry on fishing.
    I doubt it, the money is too good.

    As far as the council are concerned they have used the correct code. The DYL's restriction extends from the middle of the road to the boundary of the car park and includes what the council maintain is pavement.

    It may not be that simple in as much as it appears that the car park may not a council one, but that bays have been marked out across pavement.
  • Sorry spacey2012 but I'm not sure I understand your last post. Are you saying that if I push ahead with disputing it the council are likely to drop it because if I push on and win they will be forced to stop issuing tickets relating to that particular offence in that particular car park ? So it's worth just letting me off so they can continue stinging other people who just pay up without disputing the charge ?
