Going to lose holiday allocation - can anyone help please?

Hi there,

Where I work, our holiday year goes from April 1st - March 31st which means we have to use our allocation by then. We are allowed to carry over 1 week but any surplus is lost. Now this I kind of accept however there has literally been NO holidays allocation since at least September which means there is no opportunity to take it.

I have checked today on the system and there is nothing but the odd hour here and there right up until 31st march.

Is there anything that can be done about this as this seems totally unfair?!

    I thought this, but after checking it out, I was told no, we'd lose them!

    This is only told to me by colleagues though and my DH who works for the same co. I have checked our intranet site previously and believe it is correct.

    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    Because there has been none available. There is a system where our scheduling team upload the amount of hours allowed on a particular day and there has literally been none.

    I only moved to the department at the end of Aug - just after I had my summer hols. One of the first things I noticed people moaning about was lack of holidays to take!
  • Sorry should have said, I normally save some hols for xmas time (this was on lockdown and only a tiny amount of hours released - fair enough) and also spring but as I said, there is nothing!

    It is possible that there were some hours to take in Sept/Oct but as I had just had my summer hols, didn't 'need' to take any at this time and was not advised/warned that no more would be available after that!!!

    Yes there is something that can be done about this. Your manager who told you that you would lose your holidays is wrong. The employer must allow you to take your statutory holiday entitlement (usually 28 days/year). In fact they have a responsibility to ensure that you do. They may tell you when you can or cannot take them, but they have to ensure that all employees take their paid holiday entitlement.

    They may allow you to carry some over to next year, but they have to permit you to take the remainder in this year. This is not an option, this is a legal requirement. If their system is not permitting people to take holidays to which they are entitled then they need to change it.

    You need to put a request in writing to either your manager or HR dept. If your manager is of no use then raise a grievance. Outline in your letter/Email how many days holiday you are have left to take and state that as there is no possibility to book them before the end of the holiday year that you want them to tell you when it will be convenient to take them.

    Surly if you are unable to take holiday due to the company not letting you, they are going to have to either, let you carry them over or, pay you for them. If not what's to stop them doing this to everyone every year and saving all that holiday pay?

    The statutory leave entitlement for full time workers is 28 days, including public holidays. Your employer is required to allow you to take this, and cannot pay you for unused holiday (although they can pay you for unused holiday above 28 days). You should insist that your manager sorts this out - what the schedulers load into a system is not your issue.

    Technically they have to allow you the opportunity to take the time of, they could argue that from Apr- Sept was plenty of time to take the time off.

    However, the OP needs to get onto their manager who should get onto theirs and so on

    I shall use that to speak to my manager on Mon (he's been off unexpectedly this week). If things aren't resolved then I shall put it i. writing.

    I actually get quite a decent amount of hols so some of it is over and above the 28 days.
