Unfair complaint from buyer...what to do?

My OH brought a Nike golf bag in the jjb half price sale. He has upgraded to some posh golf make, so we sold the Nike bag on eBay.

My OH likes to keep his things nice so it was in excellent condition and he cleaned it all before sending it off. The new bag had come in a box and plastic so we used that to package the old to send off so it would stay nice.

Today I have received the most awful phone call from a very aggressive man telling me that he has reported me to eBay for selling a fake unused item. He is going to get me in a lot of trouble so I better sought it out. He says it is a Chinese replica.

I have no idea where he has got this idea from. He says he wants a refund then when he has the money he will return the bag and remove the bad feedback.

I have never had so an abusive or nasty experience through eBay. I am sure it is not fake, but he would not listen to reason.

What do I do, how can I prove its not fake, he has the bag. I don't see how he is allowed to put feedback on my account saying I have sold a fake without any proof of this, you could go round writing this on everyone you buy from?

Any advice would be greatly appreciated, now I know why people say they feel like giving up with eBay!

    Do you still have the receipt for it from JJB? surely that will be enough to prove it's not a fake?

    Your buyer doesn't show any previous particular problems, as their feedback left for others is ok, but as you say, he says he will revise it once he is refunded - so that wouldn't show on feedback left. As he has already negged you, I would push him to open a case, then you can show eBay/Paypal the reciept - one type of case works differently to the other, someone will come along in a while and make more sense than me!
  • It also sounds pretty dodgy that he wants the money back before he sends the bag back. I would say best bet is receipt or even a redacted bank statement, if your brother paid by card together with a very very calm message stating the bag is not fake but you are willing to refund him on receipt of the bag. If he sends another email ignore him and call ebay. Just remember to remain calm at all times. It is upsetting but the best thing is not to rise to it and speak to ebay if in doubt.

    If he's already negged you - no point trying to sort things with them.

    Point out you bought it from JJB and many designer / top makes are made in China. Offer a full refund on return of the item. If they refuse and open a claim - you may need proof of purchase. There are lots of stories on here of buyers being refunded without returing alleged fake goods. Its wrong that Ebay do this.

    You have also been offered to have your feedback removed for money. Report this as feedback extorsion and it should be removed.

    Thank you everyone for your replies. The receipt just says accessories which is a pain, I think I will message via eBay as advised rather than ring back then it's all recorded.

    I think I feel most upset because I would never sell a fake, I think people who do that are so mean, I would be upset if it happened to me so I would not do it to someone else.

    I refuse to let this put me off, as everyone helping on here shows most people are nice...

    I'd just send him a message saying 'sorry to hear you're not happy with your purchase. I can assure you that it is NOT fake, as it was purchased from JJB sports on <date>. Please see attached receipt."

    I'd then respond to the neg saying "item genuine. Copy of UK receipt given to buyer"
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Thank you everyone for your advice. I sent the message explaining not fake, and able to provide receipt but explained that if it was the case that he had brought it and changed his mind then I would offer a refund when he returned the bag. He rang up said he would return the bag and like a refund in form of cheque and would remove feedback. I didn't ask him to do that as I know it's against the rules.

    It says I haven't got a negative now, although the negative comment still shows up in my list of feedback, which is disappointing.

    I just wish he had phoned up in the first place told me he felt he had made a mistake in buying it and asked if I would accept a refund on return, I think life is much nicer if people are just nice.

    If he paid via Paypal I would refund by Paypal. Just in case he's raised a SNAD through them and forgets to mention he's had the cheque refund.

    Obviously only refund once you've had the bag back.

    I would also refuse to answer his phone calls and make sure he puts everything in writing through ebay messages!

    Don't send him a cheque if he paid by Paypal or you may end up refunding him twice and don't refund at all until the bag is back in your posession.
