Hopefully the OP will update later. Should have gone well and, hopefully, the Claimant has been invited to withdraw her claim.0 -
Hi all
equaliser123 and jbworldwide, thank you for rememberingI thought I would let you all know what happened today.
Basically the judge was rather scathing and incredulous towards the landlady as he said the claim she had put in wasn't valid, as she had received the bond back, and she said she was now wanting EXTRA costs for a window frame (an extra £225) that apparently has a cigarette burn on it (no idea how that got there tbh, my mum didnt smoke but she is blaming me for it even though I NEVER smoked in that house as my mum had chronic emphysema! )- , as well as her wanting £80.00 for the costs of a new carpet as she claimed my Mum's cat had peed there- we werent aware of the cat doing that, BUT there was a flood that happened not long before my Mum died which i think was the cause, and the landlady was aware of at the time, and tbh why wouldnt the £400 bond cover that?-
Anyway in a nutshell the Judge said that as my mother has no money left and had no estate etc, that she would not get the £80.00. As for blaming me for the cigarette burn (which i suspect could have done by a plumber who was putting in a new boiler when my Mum was in hospital, but not sure of course), the Judge said she would have to prove that it was me and she is only supposing and it would be wasting Courts time with no evidence, he said that really he thinks it would waste too much of her time and money taking this any further, and obviously she wouldnt get anything. BUT if she wanted to make a claim against me anyway, she could for the £225, as that is up to her. he has given her till the 17th June to put in for a new claim against me.
I hoping that she has finally realised that she will get NOTHING from me like the Judge said, but after seeing this woman today she seems to be an arrogant, stubborn woman, and she was shocked at what the Judge said, so I guess its more wait and see, I do feel relieved though now as she hasnt a case against me, as obviously she has no proof about the cigarette burn. I am incredibly angry however that she has the cheek to blame me over the cigarette burn, she thought she was so clever saying "her mother didnt smoke, but she did"- how dare she, when the Judge told her she could not prove that her face was a picture!
So basically she has spent £60.00 for nothing and then if she does decide to go ahead thats an another £60.00 + costs and she will obviously lose
I want to thank all of you so much, for your advice and support over this over the last four months, it has been invaluable, if she DOES go ahead with another claim against me I will let you know, but I am hoping this will be the last I hear from this awful woman.0 -
Glad to hear things went well.
Hopefully the horrible woman will crawl back into her hole now!
Lots of hugs!

The best form of medicine; to hurt her in her pocket. I'll be very suprised if she turns up again but if she is THAT stubborn, you never know. If she does, hopefully you can relax in the knowledge it will be spurious and she is wasting her money and time again... obviously that doesn't stop her wasting your time though.Target to be debt free: Dec 2015 (33 and debt free

Thanks Heartbreak and jbworldwide
I hope she will do the most logical thing and now let it drop, I don't have any more time to waste with her pathetic games as I need to get my house on the market and move, I certainly don't want to have to come all the way back here to attend a court case knowing she is just wasting time and has no chance of winning.0 -
I'm so glad that things went well. I'd been wondering how you got on. What a greedy and heartless landlady.
I hope she'll let things drop too.0 -
Thank you madget0

I'm sorry I didn't see this thread earlier, I really feel for you and I am glad the outcome was a good one.
Just one thought - IF she wants to proceed with another action you will be 'way up North'; hopefully the travel costs for her to your local court will make her think twice0 -
Thank you Ky822000!
That is a GREAT idea, thank you!! x0 -

Assuming, of course, that the claim is transferred to the OP's court...0
