Hi all,


I’m hoping someone out there will have the answer……about 2 yrs ago my husband took out a contract for me from VM as a gift. In November 2012 they called me to say my contract was due to end and did I want to take out another 18mth contract. I explained that it was in my husbands name and they said it didn’t matter. I agreed to the new contract thinking they would put it in my name. Then the probs began:
  • Sent wrong phone – re-sent new one about 2 weeks later
  • New phone needed micro SIM which didn’t arrive (still hasn’t)
  • Been using old SIM and old phone for over month but paying new price
  • Been told 3 times it will arrive via next day delivery – it hasn’t
  • Formally complained on 7th Jan and said I wanted out of contract – haven’t heard anything back
  • Called again today to log that still no SIM received – again promised that it will arrive tomorrow. In meantime the silly man I spoke to has de-activated my current SIM so I can’t make any calls/texts. Called back and told it was irreversible and must wait for elusive micro SIM to arrive.
So now have no phone at all!

Anyway long story short due to all the issues, time wasted on phone calls, emails, letters ect I want out of this contract but clearly they are saying tough. However……as it was taken out my husbands names without his knowledge or consent (they called me I explained they said it was fine!) surly he can cancel it? Please can anyone offer advice?

    Oh dear, what a mess! Return the phone (this will be under be DSR) do not accept the SIM as the use of this confirms the contract, if sent Recorded refuse it - if delivered, return to the address on be package, and keep a Certificate of Posting.

    You will be have deemed to be acting on the authority of your husband - but it is a minefield. The best thing to do is to get him to write, advising as service has been terminated, he is not requiring ongoing service and your contract ended. As there's been no service under the new one, they cannot insist on it.
