    Yeah no money is taking until the send it but you never know if they might try to pull a fast one, ive pre-ordered a dvd in march
  • I would like to ask why it is considered theft if a person walks into a HMV store and leaves their gift vouchers in exchange for goods? Surely you cannot steal something that you have paid for and are owed?

    A gift card is simply a promise it will let you spend a certain amount in its
    store or on its website. So under insolvency law, it is up to the administrator
    whether to accept vouchers

    You've already spent the money instore. The gift card just lets the recipient chose what they want? To me refusing to take them is theft. It's no different to going instore buying say 5 DVDs and then the security man refuses to let you leave with your items. In both cases you have paid for your items but are refused them.

    I did have the same thought as sammieonline. So what's the legal stance on that thought?

    I used to work for HMV and still have an HMV pension.

    What will happen to this and will I still be able to move it to my current employer?

    The article is wrong when it says about taking products upto the value of the voucher.

    Under common law you are entitled to take products in lieu of payment. This is called a 'Lien', you give the store people your name and details and state that you are 'holding' these items until your voucher is honoured.

    This is how bailiffs work.

    No, they've said they won't take any money until the goods are despatched and they'll adhere to this undertaking. Whether these pre-orders are ever fulfilled depends on whether the firm finds itself a buyer or ceases to trade altogether.
  • I had some evouchers for HMV . When the news broke last night i thought i might as well try to use them . Ive ordered 5 blu rays for 30 quid . I received an automated email last night re order . I received emails today saying 1 is not in stock but the others have been posted to me .
  • To stop all the problems with vouchers and gift cards, companies should be made to ringfence the money paid for gift cards/vouchers. If a companies goes into administration then we should be allowed to apply for our money back from the ringfenced account.
    I have started a epetition on direct.gov.uk to this effect please sign it and start helping us protect consumers

    HMV is no longer trading, Deloitte now has the reins. Therefore a store that no longer exists cannot redeem giftcards/vouchers.
