It's not nice or ethical - but if EAs incurred any sort of legal action for every lie they told, they'd fill the courts all day, every day!
Really don't know what 'action' you want/expect to take.
There's a site for EA reviews - all I'd do is add stuff on there - but be careful what you say! Without actual hard evidence, you're stuffed, and you might find yourself done for slander.

if you have no evidence to prove that they did this then there isnt much you can do.
is it unethical, yes but is being unethical a crime? no (unfortunately).
you wont get an apology as they were no longer your agents and therefore not working in your interest working for their own (ie to keep the buyer for one of their properties).
highlight this to others and they could go against you and without proof you would be in the wrong.
horrible situation but not much you can do now.
EDITED TO ADD; it could be that the parking issues and unsafe building work has come from feedback from other people who have looked around. i doubt they said it so bluntly, the may have said 'we believe that XYZ is the case' and in which case they had a duty to manage the expectations of the buyer.0 -
I would be taking legal advice - and not making things harder for a lawyer with an angry email. I might also be sending a mystery buyer to collect evidence - but you have made that a far less useful tactic to nail them - although you should let the dust settle for a week or 2 and think about sending a mystery buyer anyway.nattyb1982 wrote: »what might you suggest Val? You say it's 'under investigation' by the Property Ombudsman? Is this true? Has the PO opened a case for you?
The PO won't take any interest in your case until you've been through the EA's full complaints procedure, and they'll want to see evidence of this in the form of correspondence, etc. between you and the EA. Is there any?
You also say you'll be "sending copies of this email over to all local newspapers, TV stations and pretty much anyone I can." - you'd better be sure of your facts, and how you can prove them, because this essentially comes over as slander, blackmail, or both. "Toe my line or I'll badmouth you all over town", essentially.....0
