please help!! credit card payments deducted from bank account

hi there.......

My wife and i have a halifax bank account and also a halifax credit card which is at its limit and is not used anymore.. but intrest occurs every month.

we try to pay the monthly installment, but this is not always done. however, recently when my salary is paid into the bank, the halifax take it all to pay off the credit card without even notifying us. hence leaving us with no money in the bank and direct debits being returned.

are the bank allowed to do this and leave us in such a terrible position....please help!!!!!!

P.S we have spoken to the bank and they just say it is to pay off the card....

    Have you spoken to the Halifax regarding coming to some kind of payment arrangement regarding the credit card?

    Also you might be better off setting up another bank account to get your wages paid into to stop the plundering of yur account.

    Halifax - Bank Account Conditions
    6.2 If any money is overdue for payment on any other account you have with us, whether in your sole name or in joint names; we may take the money you owe us out of your account. If your account is a joint account, we will only do this if the overdue debt is also on a joint account held by the same people. We can do this without giving you notice.

    although this is in the t&c's surely leaving a family with no money and allowing direct debits to be returned is not fair...especially without giving any notice

    oh and yes we have an arrangement with the bank and ok we havnt been the best in the world and keeping to it but we have been makng some payments

    They unfortunately have the right to take it out under their T&C's plus you've broken an arrangement with them. Have you thuoght about opening another bank accont for your wages etc to go in and move DD's to the new account as well? You might want to check out the Debt Free Wanna Be section on here as well as this might help you as well.

    That is despicable.
    Against all human common sense and values but what does the bank care if
    you can feed your family....

    Open a new current account with another bank.
    Cancel all your Direct Debits not to incur Failed DD fees.
    Ask your employer if there is any chance of them retrieving your salary and
    depositing it into your new account.

    It does seem as though you did put yourselves in this position, not the bank, by not paying what you had agreed you would pay them.

    You would be best talking to them calmly about coming to an arrangement for managing your accounts from this situation.

    Having the right to do it does not mean that it is right to do it.

    As advised, switch both accounts to two different companies.
    The acquisition of wealth is no longer the driving force in my life. :)
