I'n not in this position and have no idea how most benefits work but, if the OP partner signed a legal declaration with a solicitor staitng that s/he did not pay towards any bills or up keep on the property and both monies were seperate would they still take this persons wages into consideration?

Yes - the law regarding Tax Credits is stated in black and white that if you live together as part of a couple, single sex or hetrosexual, then they calculate your tax credits based upon the total income of the household. It doesn't matter what your personal arrangements are, but if you are a couple then you must be treated as one. How you decide to spend your money between you is up to you. It is the same for all benefits (unless they state otherwise, such as incapacity benefit).

It must be difficult when you have a change in circumstances and are used to receiving X amount of money in the form of tax credits. However, an acquaintance of mine "split up" from her husband and claimed as a single parent -2 years down the line she's being prosecuted and has to pay back the thousands she's fraudulently claimed ?? Did the luxury hols in the Bahamas with her "ex husband" give her away!

Personally, I'd rather be able to sleep at night and be richer in other ways.
  • thanks for all of your help, ive sent off the declaration that hes now with me:o

It would be a lot quicker to just call the Tax Credits helpline and inform them your partner has moved in. The declaration form may take 10 - 14 days to be processed, any payments paid to you through your single claim from the date your partner moved in will be classed as an overpayment.

If you call the helpline, they will end your single claim and send you a new application form out to reapply as a couple.
