T-mob ufix stitch up
Options
Hi everyone.
I had my daughter on a ufix tmobile plan, sim only. Thought the concept behind the idea was great, costs me as much as I was spending on topup. For her birthday in November she was desperate for a blackberry, the phone she wanted was available on a ufix contract so I upgraded to a fixed term. I had to phone to upgrade current sim, where I was very specific about wanting ufix. I expected to pay £80 for the phone where the guy told me if I paid an extra £5 I could have an extra bolt on and could have the phone for free.
Today I see on my bank they were going to take just under £50 by DD, surprised I phone them up to find out at point of sale the man had out me on a normal contract without telling me.
Customer services at this point now is disgusting. Ive been cutoff and spoken to like a stupid 2 year old. to say that i am livid would be an understatement. Apparently it's my fault, I would of got a text message and raised it then, don't remember getting a text. I've been told I can have a ufix plan as of today for £20 or send the phone back and that I'm lucky as they don't usually offer this but under the circumstances..........
Am livid.
I put the phone down, I couldn't control myself being on the receiving end of such condescending attitude. I have written a complaint to Sunderland office requesting for this to be fixed or I will happily go to ofcom, I have asked for a manuscript or audio file of the call from point of miss-sold product. I want the contract backdate to a ufix.
The very point of me choosing this for my daughter was so there would be no problems and so far it's caused me more fuss than my own contract.
I've cancelled the DD for tomorrow though I will pay by debit card on Tuesday, I don't want this to damage my credit file hn I'm trying to clear it up to buy a house next year.
Please someone tell me, what are my rights, what can I do and what should I expect. I will happily self represent and take them to court myself.
Thanks

Start with demanding the recording of the conversation to be found and listened. For any agreement reached over a phone you must demand a confirmation by mail/email/text and check it. Now the recording, if it exists, is your only hope.0

Thank you, exactly what I have done.
It has been confirmed that my calls have been recorded. I asked for it to be listened to but they were really cagey, within letter of complaint dated today and already posted I have requested a manuscript or audio file of call.
I won't give up, I will fight this for the resolution I deserve until the day I die but I feel awful for my daughter as I have taken the phone and put it away in the event it is returned.
