Help! Albany chasing me for hire car charge costs

Dear all,

I am not sure what I should do. Albany could not retrieve hire charge costs from the third party so they are now chasing me for the cost, claiming breach of contract.

  • They have 6 years to pursue for it from the date of the alleged breach of contract.

    You need to read the terms and conditions of the document you signed, ideally before actually signing it but now at least will at least tell you exactly what you agreed to.

    What is the actual alleged breach? its not clear from your comments

    They would have to enforce the contract in court, which will be the high court given the amount who will pick the contract apart like it is a game of sport, word for word.
    Will they chance their hand on hear say ?
    I would say not.
    I certainly would not be paying them with no judgement.
    If you dont have legal protection on your household insurance, now could be a good time to purchase some.

    Since when did £13k start going to the high court? Hell, in a couple of months Small track alone is going to be a £10k limit (non-injury)

    I'd have thought that any legal protection purchased now wouldn't deal with the existing issue.

    You have a duty of care to keep costs down, think they are right to challenge the costs as you could of done with a focus or something.
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Does the duty to mitigate extends to having a lesser/smaller standard of car? If it does then does it also extend to say using the bus and not having a car at all? Walking everywhere would be cheaper still

    I'd have said the duty to mitigate only extends to not having a better than original car, only getting one if you could/might use it and only using credit hire if you can't sensibly afford to hire one on normal rates

    Out of interest, you mention the hire is disputed as your partner used the car while you were injured. Did your partner have their own car they could have used?

    You mention you could not drive the car as you were injured for two weeks, was the injury very serious and if so were Albany aware of the seriousness of the injury before they supplied you with the car?

    Did you follow the advice in the previous thread and request a copy of Albany's file under a subject access request?

    P.S If all else fails perhaps you and the company could do a Stevie Wonder and Paul McCartney cover of Ebony and Albany
