Hi, Had a response to my NBA that Virgin would stand their ground and reject my claim. Its upto me to take it further.
So small claims court or 3rd party no-win no-fee company. Can anyone advise any good no-win no-fee company please as I think it would be less hassle and no upfront cost!
I am prepared to lose 30% compensation with no-win no-fee company (presuming 30% is correct).0 -

Now I also have been studying Flightstats.com for reference to your Virgin flight number etc., and cancellation, see below?
Thursday 16/5/2013 no virgin flights depicted from YVR.
Friday 17/5/2013 no virgin flights depicted from YVR.
Saturday 18/5/2013 VS96 departing YVR at 10.25 pm.
Sunday 19/5/2013 no virgin flights depicted from YVR.
Monday 20/5/2013 no virgin flights depicted from YVR.
Tuesday 21/5/2013 no virgin flights depicted from YVR.
Wednesday 22/5/2013 VS96 departing YVR at 8.25 pm (your flight presumably).
Thursday 22/5/2013 VS96 departing YVR at 8.0 pm
Friday 24/5/2013 no virgin flights depicted from YVR.
Saturday 25/5/2013 no virgin flights depicted from YVR.
Sunday 26/5/2013 no virgin flights depicted from YVR.
Monday 27/5/2013 no virgin flights depicted from YVR.
Tuesday 28/5/2013 no virgin flights depicted from YVR.

Heard back from Virgin today - they intend to defend ... will have to wait and see what happens.
For info - below is a list of the stages we have gone through so far.- 30/12/12 - Sent initial letter
- Early Jan - Asked to complete forms
- Mid Jan - Confirmation forms were received and advised 6-12 weeks
- Late March - Letter declining request citing Extraordinary circumstances - however, unlike EVERY response I have seen on here Virgin never said what the fault was or provided any details just said a technical fault.
- Mid April - issued NBA- no reply received
- 09/05/13 - Created Small Claim via MCOL
- 15/05/13 - Papers were served to Virgin
- 23/05/13 - Received notification from the Court that Virgin intend to defend their claim and have 28 days from 20/05 to defend their claim - so.... waiting for 17th June to see what happens next

It really is quite irritating to hear Sir RB bleat on about fair play etc ( The Virgin train bid for example) when his airline appears to be deliberately trying to avoid complying with their legal (let alone moral) obligations.
Totally agree. I have more respect for O'Leary at Ryanair who at least makes no pretence about treating customers well0 -

I am posting to see if anyone thinks that I have a claim? I have read many of the threads and Virgin don't sound an easy company to claim from.
I booked my holiday with Voyager Direct but it was a Virgin Holiday and Virgin flights. Would I put my claim to Voyager or Virgin?
Ok, we set off on time from Manchester Airport, however approx 2 hours away from Barbados. We were told a lady had a stroke on the plane. She was sat near to me and she was a Barbados national. They decided to redirect the plane back to the Azores which was approx 1.5 to 2 hours flight back. Almost the same time as if we carried on to Barbados.
When we arrived to the Azores, it was at least 30 mins before this lady was taken off the plane and she looked ok at this point. The rest of the passengers sat on the plane for approx 2 hours and were told we would take off asap. However after this time. We were told it was not possible to take off anymore, we exited the plane and were put up in a hotel overnight with meals. We departed the Azores the next day at approx 2pm and arrived in Barbados 4 hours later. The lady that was ill the day before got back on the plane with us. I believe that they didn't take off again on the same day because they knew this woman would be ok to travel back the next day and there were no other virgin flights from Azores to Barbados. We landed at a military airport.
The delay cost all the rest of the passengers on the 747 plane a day of their holiday. I was only there for 7 days so it ended up a 6 day holiday. I believe that Virgin made a mistake in redirecting the plane as the distance between Barbados and the Azores was almost the same when the plane turned round. I think we arrived in Barbados almost 24 hours later than scheduled. They handed us vouchers to claim airmiles on landing, saying sorry for the delay.
Also the person I travelled with is an ex who I no longer see. Would I be able to claim without them for my part of the journey? The holiday was booked in my name.
I know this sounds complicated but if anyone thinks I may be able to claim your feedback would be appreciated. Thanks0 -

Just my personal opinion but I think that you would struggle. This doesn't appear to be anything that Virgin could control by action before the event and I suspect that the decision to head for one emergency landing site rather than another would be deemed to be "reasonable" in, what was believed to be, a life or death situation. I can see any defence laying it on thick about how their only concern is for passengers ....
As I say, that's just a non-expert view. I would be interested to hear others' thoughts.0 -
Thanks for your quick response David. I think the same but it would be interesting to see what others think. It may be worth talking to a no-win no fee company, may be better to argue my point than me.0

My personal view is that you would struggle to persuade a court that this was not extraordinary circumstances. Sorry.
Presumably you made a claim under your travel insurance?0 -

This may sound daft but I didn't. My travel insurance is Virgin too and I thought because they gave us meals and accommodation I couldn't claim. Then recently I came across the flight delay compensation thread. Thanks for your reply!0 -
I think I am going to use a claim company airline recovery only take 25% of comp does anyone know if they are any good?0
