  • Hi Mark.
I received the exact same letter from them but my flight was to Orlando VS015!
How have you got on? Any luck?
I'm disgusted at the response, as my delay was for over 24hrs! And it is clearly the airlines fault!

Has anyone had any luck claiming back for Virgin flight VS002 from Newark on 3/9/2012?

I claimed and received the following:

"We regret to advise you that we have declined your claim on the grounds that the cause of the delay was caused by extraordinary circumstances which were beyond the control of Virgin Atlantic and which could not have been avoided even if all reasonable measures had been taken.

"The aircraft encountered an unexpected technical problem prior to take-off with one of its thrust reversers. Our engineers tried to fic the problem however after further investigation replacement parts were need to be sourced in order to rectify the problem, which could not be obtained locally."

As per the examples above re: technical issues, it sounds like they were wrong to deny the claim (and I will go back and challenge them).

I was wondering if anyone had successfully claimed for this flight?

    Thanks,

    Mark
  • Hi.
I'm in the same postion with the exact same letter, but for a flight to Orlando VS015, delayed for 24Hrs!
I agree with you completely, it's a disgraise & a cop out by Virgin! I'm not going to give up, as it seems we're not on our own here, but not sure how to proceed, please keep posting as any info would help :-)

    Hi,

I am looking for some advice if anyone can please help!

We were on the VS66 MBJ-LGW 13/3/2013 which was delayed 26 hours after two aborted take offs due to a technical fault with the aircraft.

I have submitted an EU261 claim to Virgin Atlantic which has been denied on the grounds ' that the delay was caused by extraordinary circumstances which were beyond the actual control of Virgin Atlantic and which could not have been avoided even if all reasonable measures had been taken' and due to 'technical problems stemming from events which by their nature or origin are not inherent in the normal exercise of our flying activity and are beyond our actual control'. They also state that 'the disruption was caused by an unexpected fault with our steering actuator shortly after pushing back for take-off. We returned to stand to investigate and rectify the problem however the airport closed prior to the fix being completed therefore we had no choice but to delay the flight further.

Surely the maintenance of aircraft parts is absolutely within their control? Especially as the pilot announced that this was a problem that had been noted on the outbound flight! The letter also neglects to mention that the reason for even further delay was that we had to wait for the replacement part to be flown in from the States.

Where do I go from here??

I appreciate any advice you have for me, thanks in advance!

I know this is a long shot but would appreciate advice on whether we may be able to claim for a 28 hour flight delay in march 2005 with virgin atlantic due to problems with the plane. We were stood at check in and the first indication they gave was to put a "flight cancelled" sign up on check in. Did not take off for over twenty eight hours.

Just asking because Martin commented on his programme that it could be possible to go back to feb 2005 but wondered if anyone else has tried.
  • I was on Flight VS 34 from Antigua to London Gatwick scheduled to depart 8th December 2007; however, the pilot managed to leave the runway, the wheel became stuck in the mud surrounding the runway, and after sitting in a very hot plane for an hour we were deboarded. following another couple of hours in the airport, during which time the runway was closed to new arrivals and departures, we were taken overnight to hotels - the next day there was major confusion and ultimately the plane took off over 24 hours late (a new wheel had to be procured from another island). I have evidence of this as it was logged on a number of website - apparently it wasn't the first time that pilot error had caused problems on this particular runway. At the time I was offered virgin miles as compensation, and 1 free flight, but we rejected this and I have never flown to this day (conditions by the time the plane took off were poor and there was a lot of turbulence). However, when I used the link to 'check if my flight was actually delayed' Virgin are showing a delay of less than two hours - why, because they are basing it on the 'rescheduled' time, rather than the original time. I have my baggage reclaim tag which shows the plane departed 9th December not 8th December, and that it is in fact nearer to 26 hours late than 2 hours - also have the exit stamp on my passport from Antigua showing 9th not 8th December.
Is there anyone else who was on this flight, or who has experience of Virgin trying to deny a delay?

I don't understand Londoners, have you actually commenced a claim against Virgin, and received a denial?
  • I have submitted a claim and am awaiting a response, but the reason I suspect Vurgin will try to deny is that having used the link supplied on this site to check, Virgin are not providing a true report of the flight and are showing tge delay as 2 hours rather than the true delay of 26 hours - luckily it was well documented elsewhere due to the circumstances, and I still have the stub of one of our boarding cards, so I can evidence the delay. Don't hold out much hope having read this thread though.

  • My children were on a trip to san fransisco where they were delayed an hour then when they took off 20 mins into flight engine failed so they turned back, took them 90 minutes circling to be able to land then another 3 and a bit hours to get new plane sorted out, will we be able to claim for them?
