  • I've read through some of these comments on this forum and wanted to explain my position as I've only recently found out about this and didn't want to waste time if my claim would be dismissed.

    18th May 2012 me & partner where booked on flight to Gibraltar from Manchester flight was supposed to take off around 2:30pm. We ended up taking off at approx midnight and the reason provided by monarch was that Gibraltar airport was closed due to adverse weather.

    However, the hotel owner was emailing us to confirm the airport was indeed open as normal and flights where coming and going from Gibraltar all day as normal.

    Reading other info I've seen would suggest that weather is not a reason to claim, however the airport was certainly not closed as we where been told by the monarch reps in Manchester.

    Is it worth claiming for the 10 hour delay and how could I prove Gibraltar airport was open?

    GIB is frequently closed due to weather.
    There is nothing 'extraordinary' about these closures.
    Many flights are diverted to Malaga AGP when GIB closes.
    Posts are not advice and must not be relied upon.

    I get the feeling that posters on here are assuming that Monarch is raiding its own bank account for the payments and thus is simply delaying writing the cheque out.

    Far more likely that Monarch have insurance against such risks and might be acting in accordance with the terms imposed by the insurance. The legal team that is spoken of might not be Monarch's legal team but a third party operating on behalf of the insurance who will attempt to deny claims at all costs - even to the extent of making it a war of attrition in the hope a claimant will go away.

    Hi guys,

    I suffered a 5 hour delay last June with Monarch from Gatwick to Alicante. No explanations, no food vouchers, nothing.
    In December I sent Monarch the claim form with all the paperwork they were requesting, and they replied 2 weeks after saying they would look into it.
    Now I finally got my reply:

    *The previous flight had a technical and staffing issue*

    What now? Off to court?

    Yep, straight to court. At least Monarch have dug their own grave on this one lol :rotfl:
    Claiming that a previous flight is an EC is taking the biscuit.
    Blondmark recently posted a snip of the ruling that shows that previous flights are not part of the EC circus.

    How was this *reason* provided?
    I ask as, unfortunately, you have to go through the motions of claiming, before you can issue a court claim.
    If you've already don e the claim form and the wait for a reply bit, then you can go straight to court from here.
    Otherwise you'll have to play the game i'm afraid.

    Thanks, that's what I thought. Is there any guide on the website on on how to take the case to court?

    Hi everyone,

    Just after a bit of advice. We travelled on Monarch ZB214 from Gatwick to Faro on 21/12/2010. Should have left at 7am. We were delayed 8 and half hours at gatwick, no vouchers food or anything.

    The day before there had been snow and lots of flights delayed/cancelled. However was cleared on day of our travel. Checking on Flight Stats (great info whoever posted that link) shows that 60 out of 63 flights that left Gatwick between 6am and 8am that day were on time or short delay only. Only ours and 2 other flights were delayed over 3 hours.
    Do you think i could make a claim, or will Monarch use the 'Bad weather' as a reason not to claim?

  • I am a pensioner and so fed up with Monarch. We put in our claim in November for a flight delay in November 2011 to Lanzarote.We had already lodge a claim before the EU dismissed the airlines appeals and passed the rules for flight delay compensation. it seems Monarch when they do reply used all type of tactics to avoid paying. How can having a defective part be extraordinary circumstances. Has anyone set up a website anywhere where customer have claimed listing what flights have been settled, denied or pending. if we were more technically able and younger we would try and start one, then when people had submitted claims they could add the flight and date of claim. That would soon build up and maybe pit pressure on Monarch. We are considering writing tio the CAA but is it worth it.
