What *I* would do is simply that.
Yes, though my point was that without the 'I', it's all a bit 'anal' (which given my excessive reading of European court judgements, I fear I am now in danger of becoming):D0 -

You can ask those questions in court and put the airline to proof that a technical issue the day before should count as extraordinary circumstances.
I believe you have a very strong case.
I appreciate the advice that Monarch are trying to fob me off and that i may be wasting my time in writing back to them. But as i am not litiguous by nature, i will give them another chance even to fulfil what is says in Mathew 5:25. In this case rather then prison Monarch paying 8% extra + on the whole amount since 26 July 2008.0 -
Yes, i will, but where else can you get 8% interest on 2000 Euros nowadays?0

Hey guys, when sending your N1 form do you send it to your local court or Northampton?0

Don't 'bank' on this as it means the airline staying in business, the DJ agreeing 100% with your claim and the airline not settling on the 'steps of the court'.
I think it is the first of these considerations that has dissuaded me from playing the long-game, and seeing how others have fared. There's quite a bit of internet chatter suggesting that the longer term financial position of Monarch is not good (I don't think they make a profit) - and if they were to go bust, all the claims not yet paid out would fall away.0 -
Monarch (unlike say Ryanair and EasyJet) are a privately owned company and in effect owned by one guy. The CEO and other board members have promised him that Monarch will return to profit this year after two years of making substantial losses (he pumped in £75 million of his own money last year alone!!!) and indeed they have a new team in place who are starting to make in-roads to reduce the deficit however their accounts seem to indicate they have made no provision for any delay claims. Looking at this from a total extreme Monarch have a terrible record for delays (basically of the main airlines they are the worst in the UK) as 3% of their flights are delayed over the 3 hour threshold so as they carry 6 million passengers a year this equates to 180,000 pax a year who are delayed or over the 6 year liability period over 1 million potential claimants as Monarch seldom record weather problems/strikes for their delays as it is almost always a 'tech problem'. Given their exposure per pax is either 250€ or 400€ average this out at say 325€ and you can see the problem ie c. £300 million. Now I know every delayed passenger is not going to claim indeed very few do however any claim is going to effect their bottom line and probably explains why they are rejecting 99% of claims.0

It doesn't look good in the worse case scenario. Yet I believe that I'm the only one on my flight that has claimed, and I'll bet that there's almost 100% of flights of over 3 years that won't attract any claimants at all.
So realistically the payout could be as small as 0.5%, - which is a paltry £1.5 mill. Obviously some staffing costs and lawyers fees for defended cases to add to that, but they might get away with £2 - 3 mill payout.
They can wear that.0 -
MON 1860 19/08/09 from Manchester to Marsa Alam was delayed 25 hours due to Technical fault which led to the crew going out of hours.
I received an email from Monarch on 7th March 2012 confirming that my claim has been accepted, and a cheque will be with me within 14 days0
