  • Need a bit of advice please..

    A couple of weeks ago I parked my car in an Asad's car park. I parked on the outskirts of the car park and there was a kerb at the end of each parking space. The kerb looked just like any normal kerb you would come across.

    Anyway, I drive a 7 seater Vauxhall Zafira as I have 2 kids and 2 sets of grandparents, and as it is a long car I tend to drive right in to the parking space till my wheels touch the kerb so that I know the car is definitely fully in the spot. I did this, as usual, but this time, I heard a grating noise as I parked. I stopped immediately, however when I reversed, my bumper was pulled off the car by about 2 inches, the headlight looked dodgy and the whole front of the car was boogered.

    I have had to get the car repaired through my insurance so have lost my no claims bonus and had to pay an excess of £200. The repairs came to approx £700 in the end.



    So, the question is, am I..
    1. a bad driver who should suffer the consequences of my bad parking?
    2. a good driver who hasn't claimed on his insurance for 25 years who should seek some kind of compensation from Asad's?
    I have no idea what the answer is, just hoping one (or more) of the Elite can assist. If I should try Asad's, is there an email address I should contact?

    Sorry but you were driving and you knew there was a kerb there. Pretty sure they would point to the disclaimers that are normally all around their car parks. Take it on the chin and find another way of parking :)

    Lagging behind at the moment, OH's Mum isn't well and is in hospital after collapsing, so he's had to go to Glasgow. Still don't really know what actually caused it, but they are keeping her in, so it's fingers crossed at the moment that she will be ok.

    Going to try and have a quick catch up and relax for 10 minutes :)

    Edit: What if there was no kerb but you didn't notice and there was a cliff, would you have driven off the cliff ? :D

    I did report it to the store manager but he said there was nothing he could do at his level, I had to go through my insurance.

    My insurance company are not prepared to pursue the matter any further, even though I have paid extra for legal cover.

    There was a witness who said that she had seen exactly the same thing happen to someone else recently, however, I was too panicked about what had just happened to my car to get her details.:(

    Hi SFSB, think this is key as your insurance comapny has a much greater potential recovery than you, ie £500. If they are not pursuing it then they will not rate the chances of success too highly. They deal with thousands of claims daily so have a very good idea of how such things pan out.
    As I said, I really have no idea who is at fault, me for not judging the height of a normal looking kerb or Asad's for having an overly high one that wasn't obvious.

    Maybe neither? Accidents happen and quite often they are no-one's fault as such, no one has been negligent, it is just an accident and it is why we buy insurance in the first place. Not a nice thing to happen, but probably best to chalk it up to experience and move on. :) Hope you are not too shaken by it all.

    Thank you Enterprise and others for your help, it seems that I will have to take the hit as that seems to be the consensus.

    However, as a grumpy Scottish mse'er, I might just try a quick email to asad's just to test the water. Does anyone know the best email address I can contact?
