faulty blackberry on contract with 3

hi i am about 10 months into a a contract with 3 and i have a blackberry curve. the bb has been having faults for over 6 months and has been in and out for repair, due to battery draining from full charged to flat in 2 hours even when not being used! the screen also freezes for hours on end so phone is unusable! i now can only use the phone when being charged from the mains! i have contracted 3 and have been told to send it for repair again? i have said i am fed up of sending it in for repair and would prefer them to issue a different phone but they said that cant happen! how many times can they expect me to be without a phone(whilst being repaired) or expect me to put up with a unusable phone. all they say when i ring to complain is we will repair and if not happy buy out of the contract! what are my rights? as the phone is often unusable or in for repair? i have been with 3 for about 8 years and loyalty means nothing. please can someone advise me as to what to do next? :) thanks xx
