HELP - Parking Ticket in Aylesbury

Hi all, I'm new and have read lots of posts but still feeling anxious! I went to Aylesbury Shopping Park on 29-12-12, went to the shops knowing I had 2 hours free parking but because it was absolutely hooning buckets I completely forgot to get the ticket in my haste to get in to the dry. I quickly realised that I'd forgotten, approx 15 mins later and ran out to get one. There I found a parking fine from UKPC Limited. I have read their site and they seem to be members of everything including the BPA, so I'm assuming if I ignore the ticket they can get my details from the DVLA (which personally I think is disgusting) however, if I write to them to appeal, they'll have my details anyway! I think the ticket price is disproportionate to the 'crime' ie: £50 for early payment - £90 if paid after the alloted 14 day period. Basically I need to respond today to them if I want to contest it..... They have some chap patrolling the carpark permanently, waiting to pounce. I should have really remembered because when I was there a few months ago the 'said' chap even tried to ticket my car when he saw me going for a ticket and I told him what for then! this ticket says first seen 13:46 then 12 mins later ticket issued, so I just missed him! What should I do? any suggestions gratefully accepted:)

You could try ignoring them completely. No need to "appeal", as it'll be rejected by default.0

You can do one of two things:
1. Ignore it completely, and just ignore all the threatening letters they send warning of court action, CCJs, bailiffs, damaged credit ratings, and so on, safe in the knowledge that it is all crap. This assumes that you (or someone you know and trust) are the registered keeper (no need to tell us on here) - because that's who will receive all the scary crap.
2. You could appeal to them, my suggested appeal points would be that as they do not have sufficient proprietary or occupational interest in the land then they are not in a position to form a contract with a driver, and hence cannot pursue in respect of a breach of such contract terms (VCS v HMRC), and the sum sought is unrepresentative of the actual losses suffered by the landowner - it being a free car park - and hence the sum demanded is a contractual penalty which is unenforceable under english Contract Law (Dunlop v New Motor Garage 1912).
Its up to you.
Either way, DO NOT PAY. You legally owe them absolutely nothing.Je Suis Cecil.0 -

Thanks 'The Slithy Tove' and 'ManxRed'. I might go with the appeal and say just that. I feel quite nervous about all this. I am normally a very upstanding pillar of the community and would normally be the first to whip out my cheque book, but I was so angry about this when the first 2 hours is free parking anyway that it has made me see red!0

There is no appeal, it is a scam, all they want is your money, it is NOT a real parking ticket, or a fine nor have you committed any crime.
Your ticket is an INVOICE cleverly disguised to look like a real parking ticket.
All they can do is use threats and intimidation to scare you.
The law is on your side, IGNORE them, do not contact them and expect more stupid letters pretending to be debt collectors and even fake solicitors .
All part of the scam that is run by these firms.
The proven way to win, is to completely ignore them and ignore any stupid nonsense and free legal advice they offer you.
It is all rubbish, designed to make you worry and pay the invoice to make them go away.
If you research the threads you can tick off each letter as they arrive, they are all on line here, some even play ppc bingo ! with the stupid letters they send.Be happy...;)0 -
I'll bet your email gets bombarded with junk every day. Do with the PPC letters the same as you do with junk email. It's exactly the same thing.
So if they can't legally get you, then why are they allowed to do this and get away with it? I know I sound a bit dim but this is only the 2nd parking ticket I've been issued in my 25 years of driving! The 1st was a council owned carpark and I just had to pay up but that was only about £20 from what I remember!0 -
But they say they can get my details from the DVLA so they'll bombard me regardless won't they?:(
if you dont pay/ignore the ticket they will pay dvla to get your details
they will then send you a reminder/threat....as much as you might be tempted to reply to this..IGNORE
they might send you a third letter/threat......as much as you might be tempted to reply to this letter...IGNORE
if your unlucky you might get a fourth letter...........you guessed it IGNORE IGNORE IGNORE DO NOT REPLY0
