    I suggest you accept the bank's offer and thank them nicely. It seems to me that is by far the best you are going to get and frankly a lot better than I would have expected to get if I'd taken out such a loan under such circumstances.

    At what point did you sit down and do your sums? When you did calculate your incomings and outgoings and decide you could afford the loan? Did you factor in payments to your overdraft and credit card? Why did you not refuse the loan if you could not afford it?

    You are totally responsible for taking the money and spending it. You are totally responsible for failing to clear or running up your credit cards or overdraft again, if you paid it off in the first place. If the loan company have already offered to refund any payments made to date, offered £500 and to start a new lower loan, remove your OD and CC and considerably reduce your monthly and interest rate then I think that they have made sufficient restituation. You have to take responsbility for spending the money. No one had your arm up your back.

    If I were offered £25k (for example) with payments of £400 a month I would KNOW that I could not afford this. Therefore, I would turn the loan down. I would not spend the money and then bleat that it had been missold.
