Car written off - Admiral refuse to pay out

  • Thanks for the replies. I didn't use a comparison site with the conviction and without, I used four different comparison sites and genuinely thought I'd covered everything. I just forgot the speeding fine as I thought it was finished and had dropped off as it was over 3yrs as per totting up rules. I didn't hide it for any financial advantage as I'm aware one 3 point fine 3 yrs ago would not stop them insuring me or be any more expensive. I'm 40yrs and got 11yrs no claims and an otherwise clean license. It was an oversight. I just suspect it may be the one chance Admiral are looking for to refuse to pay out. Its with the underwriters and the call taker stated he will review whether to authorise the payout as I'd failed to disclose therefore could have invalidated my policy.

Did you declare the conviction to your previous Insurers ? (If

Were you previously insured by other Admiral companies?

You say it makes no difference to the Admiral quote, have you run quotes through and if so have you done by correcting the age of the conviction to the same age it would have been when you took the Admiral quote out. If you did not then the quote saying there was no load for the conviction may not be accurate.
  • Insurance companies have you by the b**ls. Even though the offence lasts 3 years on the licence insurance companies ask for any offence in the last 5 years including speeding.

    I personally think it stinks!!!

You have the Rehabilitation of Offenders Act to thank for that, the DVLA regard them for three years for totting up which is a different matter.

and the rehabilitation period is set to drop from 5 to 1 year in the not too distant future
  • Admiral state they were unaware of this and won't pay, referring my claim to their underwriters.
They state that they suspect I fraudulently omitted the driving conviction to obtain a cheaper premium which is fraud so therefore won't pay me out for my written off car.

I think you're all getting slightly ahead of yourselves.

Reading between the lines it sounds very much like the OP has spoken only with claims staff, who have correctly referred the non-disclosure to their underwriters.

The claims staff have faithfully (if perhaps not too clearly) explained the meaning and possible outcomes of the non-disclosure.

Unless the OP is carrying some very borderline risk factors elsewhere there's no way Admiral will try to void on an SP30.

He's almost certainly looking at an increased premium (reduced settlement).

Ref. " I didn't hide it for any financial advantage as I'm aware one 3 point fine 3 yrs ago would not stop them insuring me or be any more expensive."

Nonsense, I found an SP30 added huge additional premiums for years after the offence and cost me much more in increased insurance than the fine. You should have declared it and coughed up the higher premium.
