Parked in residents bay and standing by car

My wife was parked in a residents bay (when she was allowed) and was standing behind the car talking to someone.

As a result, she ended up being parked after the permitted time.

The warden who gave her a ticket admitted that he hadn't seen her as he hadn't photographed the rear of the car.

He told her to appeal and also made a note on his computer.

Barnet have now rejected the appeal saying she shouldn't have been parked there.

Are there any grounds to appeal again?

    Pepipoo.com is the place for you. They have a dedicated section for council parkin so gather copies of all evidence, signs, car, lines etc as well as BOTH sides of all correspondence and pcn/nto. Use tinypic to host the pics and link to the url for messageboards on there.

    Standing near a car doesn't stop it being "parked" and although it appears that the warden could have been a bit more generous, she seems (by her own admission) to have committed the offence.
  • The warden seemed to think there were grounds for an appeal.

    a. he admitted no photographing the rear of the car

    b. He told my wife to appeal and made a note on his little computer.

    I don't know all the laws of giving out PCN top know whether point a is valid.

    I've tried to find the requirements but of course councils don't want you knowing.

    a. Taking photos is not a statutory requirement
    b. It's always worth appealing.

    What is the observation time from/to on the PCN?

    There are many appeal points not just the ones that the OP says, there could be problems with TRO, the ticket itself, the signs , the bays or myriad of other things.

    This is a money saving site, we are here to offer advice on doing that, so it would be constructive if you bared that in mind.

    You say you were in resident bay. Was that with a visitor permit or a P&D ticket?

    Nothing. Had my wife been parked there and been shopping we would admit she liable.

    In this case, the warden gave us hope.
