Smashed Screen

I will be returning my phone, under the sale of goods act, to my supplier because it has too many software bugs - however I have accidentally damaged the screen. Will this affect my rights? Any thoughts?

    dont think you can return it under the sale of goods act for software flaws. youu can take it in for them to upgrade the software however
  • Had it swapped already and the software has different flaws. It switches itself on and off mid conversation and cuts me off and often it gives me a restricted signal and I can't call out. I think it's not fit for the purpose. Two cans and a piece of string would be more useful. I've gone back to my old heap of a phone.

    You could exchange it for another handset (under the 12 months warranty). They would prob blag that they can only change it for the same handset again, but if your persistent they may give a different one.

    If you plan to return it all together, unless your within their own returns policy period, i doubt they will refund u

    I don't want a refund I just want a handset that works. I don't want to have to keep transferring data - it takes a soul destroying half day to swap the info and sim and get it all up and running again. Life's too short.

    They saw me coming - they sent me the Nokia 6280 brick that no one wants. I asked for a phone which had the same simpe Nokia menu that I was used to and I should have sent it back immediately as it strays from the simple, logical menu I asked for. 'Choose. Are you sure you want to choose this address? Are you really sure you want to choose this address?' Aaaarrrgggh! Next time, I'm going to go into the shop to try them out. I usually do.

    Thank goodness for one decent customer service guy who admitted there were faults and swapped the first handset at least - I was being fobbed off big time beforehand each time I called with yet another fault to report. They have said I can neither upgrade nor downgrade the handset without paying for it - but the phone doesn't call out and it saved 18 answer messages without letting me know one weekend. I think that they have to relent and offer me a model with no defects.

    So, what has your supplier said to you? Haven't you cracked up at them? Four phones?! Is the newest one OK? I'm using my old phone right now cos I've been flat-out with work so I haven't had the time to either argue with customer services or faff with the dud phone which I honestly could have jumped on on several occasions - mobile rage!

    However I am much more free now and I have contacted https://www.consumerdirect.co.uk (very polite and helpful - proper old-fashioned service) who have sent me a basic template letter with all the legal-speak on it, so I'll spend a few hours next week (again, life is too short and I get so minced off when I have to spend my own valuable time chasing these companies) and see if I can have a different handset.
