Marriage isn't an enormous thing to enter into if one doesn't believe in it. It then becomes a contract, a means to an end.

Actually my partner falls under both categories of that.
So coming here did help; I now now understand we can apply as proposed rather than all out married.

I don't think he does, in immigration terms.
In immigration terms, from what you've said, he's here as a student. Having arrived in 2009.
Has he applied to renew his leave to remain along the way? Is he still studying? Has his immigration status changed at all along the way?
Those are the kind of things you will need to clarify first, rather than simply 'can he apply as a partner under the new rules'.
So, I'd also recommend that you get advice from a lawyer or other who is an expert on immigration.0
