Judgement Against Barclays

Well as the title says I filed a money online claim against Barclays a few weeks ago. They wrote saying they would be submitting a defence to my claim but the time ran out on Friday and I heard nothing more. I asked for Judgement to be made and today have received confirmation through from the Court that judgement against Barclays has been entered.
Could someone tell me what happens next? Do I wait to hear from Barclays? Do they still get to defend? Do I need to wait a period of time? Really not sure what I should do next and the letter form the court is just one line saying judgement was entered against the defendant.

Any advice gratefully received.

  • well, this has just happened to me. I filed for default at 7.07am on last monday morning. The 28 days ran out on sunday but because it is a sunday the MCOL gives the defendant an extra day. The claim is entered on MCOL at 10am on the next working day. Effectively giving 29 days. They also get until 4pm on that day to enter a defence. Almost 30 days!! Surprise, surprise BArclays defended on the Tuesday, at the last minute. I got a letter off the bank telling me the case has been transferred to my local court. I then recieved a copy of BArclays defence. I am now waiting for a court date to be sent.
    So just hang on a bit. if barclays haven't filed a defence then they will surely have to pay up, otherwise you may found out that you will have to go to court, despite having been allowed to request judgement.
  • Thank you for that - I think its riddiculous that they can have an extra day in spite of the fact they already had 28! Barclays don't give us an extra day to find funds before slamming on the charges - what a cheek!

    I thought once Judgement had been requested that was it but there's nothing on court site or in the post to give me an indication of what happens next.

    I hope yours goes OK - can't believe the stalling tactics Barclays use as if every individual case is treated separately and they don't just cut and paste their standard defence. Ahhhhhh! I so want to rant about this.

    I'm tempted to send off a 7 days warning letter that if they don't pay up I'm going to issue a warrant and see if Barclays responds.

    Did you use the MCOL method? I was a day past the deadline and they entered the defence on the system after I'd asked for judgement - Now I'm getting jittery!

I checked back on mcol on Monday and it said judgement requested and then had "start" next to Warrant which is the final stage. I got a letter from the court this morning saying " In accordance with your request judgement was entered against the Defendant on 23rd April"
    I think I've won, but I'm worried that maybe I'm misunderstanding something and that Barclays are going to try something else? What do you think?
    I'm going to ring the court tomorrow and see if someone can give me more information or tell me if it's all over and if so when I can expect Barclays to pay up or if there's anything more to come.

    You now have a judgment against the bank. The bank can not now file a defence although they can ask for judgment to be "set aside" but they would have to show that there are mitigating cicumstances as to why.

    You have 2 choices.

    1) Wait to see if the bank will pay up. How long that could be is anybodies guess. It mainlt depends on what happens when they receive their judgment notice.

    2) Issue your warrant which gets the bailifs involved.

    Personally I would set yourself a deadline, of sday 2 weeks for the bank to cough up. If they don't, then issue the warrant.

  • Wooo Hoooo! Got a letter in the post this morning from Barclays saying "we don't agree with the judgement - we could easily have it set aside but because we don't want to inconveneince you with a court appearanece we'll pay up!" Aren't they sweeties!!!!! lol

    Sadly they have said they will pay money into my account - (it was closed 4 years ago!!!)
